A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE
JUNCTION,ARIZONA,DECLARING THAT A CERTAIN FEDERALLY PATENTED
EASEMENT FOR PUBLIC RIGHTS—OF—WAY PURPOSES DESCRIBED AS WAGONWHEEL
ROAD BETWEEN 6TH AVENUE AND 7TH AVENUE DESCRIBED IN STREET
ABANDONMENT CASE AB -86-02,IS NO LONGER NECESSARY FOR PUBLIC USE
AS A ROADWAY AND IS HEREBY ABANDONED AND EXTINGUISHED AS
PRESENT OR FUTURE PUBLIC RIGHTS—OF—WAY.
WHEREAS,the requested abandonment is a Federally Patented Easement
for public rights—of—way purposes described as a parcel of land located in
Section 22,Township 1 North,Range 8 East,Gila and Salt River Base and
Meridian,Apache Junction,Pinal County,Arizona,and more particularly
described as follows:
Wagonwheel Road —the West half:
The East thirty—three (33')feet of the Northwest quarter of the
Southeast quarter of the Southeast quarter of the Southeast quarter
of Section 22;
EXCEPT the North thirty—three (33')feet;and
EXCEPT the South thirty—three (33')feet thereof.
Wagonwheel Road —the East half
The West thirty—three (33')feet of the Northeast quarter of the
Southeast quarter of the Southeast quarter of the Southeast quarter
of Section 22;
EXCEPT the North thirty—three (33')feet;and
EXCEPT the South thirty—three (33')feet thereof.
WHEREAS,the abandonment requested,i f approved,would not leave a parcel
i n separate ownership without access to an established public roadway connecting
such lands with another public roadway,or have access by a Federally Patented
Easement which may in the future be developed;and
WHEREAS,the City Council of the City of Apache Junction,Arizona,finds
that said Federally Patented Easement for public rights—of—way purposes
as described herein,i s classified as a local street on the Apache Junction
Street Classification Plan,and i s no longer necessary for public use as
a roadway;and
WHEREAS,said easement requested for abandonment has never been
improved as a public roadway and maintained by a local governing agency.
NOW,THEREFORE,BE IT RESOLVED by the Mayor and City Council of the City
of Apache Junction,Arizona,that the above—described Federally Patented
Easement reserved for public rights—of—way purposes i s hereby extinguished
as present or future public rights—of—way.
BE IT FURTHER RESOLVED that the abandonment of the public rights—of—way
has no effect on reservations for public utility easements.
