A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE
JUNCTION,ARIZONA,DECLARING THAT CERTAIN FEDERALLY PATENTED
EASEMENTS FOR PUBLIC RIGHTS -OF -WAY PURPOSES DESCRIBED AS 1ST AVENUE
FROM ACACIA ROAD TO STARR ROAD AND SOLANA ROAD FROM 1ST
AVENUE TO 3RD AVENUE (EXCEPT 2ND AVENUE)DESCRIBED IN STREET
ABANDONMENT CASE AB -86-03,ARE NO LONGER NECESSARY FOR PUBLIC USE
AS ROADWAYS AND ARE HEREBY ABANDONED AND EXTINGUISHED AS
PRESENT OR FUTURE PUBLIC RIGHTS -OF -WAY.
WHEREAS,the requested abandonments are Federally Patented Easements
for public rights -of -way purposes described as parcels of land located i n
Section 22,Township 1 North,Range 8 East,Gila and Salt River Base and
Meridian,Apache Junction,Pinal County,Arizona,and more particularly
described as follows:
1st Avenue from Acacia Road to Starr Road
The South sixty-six (66')feet of the North three hundred sixty-
three (363')feet of the Northeast quarter of the Northwest quarter
of the Southeast quarter of Section 22.
EXCEPT the West thirty-three (33')feet and
EXCEPT the East thirty-three (33')feet thereof.
Solana Road from 1st Avenue to 2nd Avenue
The West sixty-six (66')feet of the East three hundred sixty-three
(363')feet of the South half of the Northeast quarter of the Northwest
quarter of the Southeast quarter of Section 22.
EXCEPT the South thirty-three (33')feet thereof.
Solana Road from 2nd Avenue to 3rd Avenue
The West sixty-six (66')feet of the East three hundred sixty-three
(363')feet of the North half of the Southeast quarter of the Northwest
quarter of the Southeast quarter of Section 22.
EXCEPT the North thirty-three (33')feet and
EXCEPT the South thirty-three (33')feet thereof.
WHEREAS,the abandonment requested,i f approved,would not leave a parcel
i n separate ownership without access to an established public roadway connecting
such lands with another public roadway,or have access by a Federally Patented
Easement which may in the future be developed;and
WHEREAS,the City Council of the City of Apache Junction,Arizona,finds
that said Federally Patented Easements for public rights -of -way purposes
as described herein,are classified as local streets on the Apache Junction
Street Classification Plan,and are no longer necessary for public use as
roadways;and
WHEREAS,said easements requested for abandonment have never been
improved as public roadways and maintained by a local governing agency.
NOW,THEREFORE,BE IT RESOLVED by the Mayor and City Council of the City
of Apache Junction,Arizona,that the above -described Federally Patented
Easements reserved for public rights -of -way purposes are hereby extinguished
as present or future public rights -of -way.
BE IT FURTHER RESOLVED that the abandonment of the public rights -of -way
has no effect on reservations for public utility easements.
