A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE
JUNCTION, ARIZONA, ORDERING AND CALLING A SPECIAL BOND ELECTION
TO BE HELD IN AND FOR THE CITY OF APACHE JUNCTION, ARIZONA, ON
NOVEMBER 10, 1987, TO SUBMIT TO THE QUALIFIED ELECTORS THEREOF
THE QUESTION OF AUTHORIZING THE ISSUANCE AND SALE OF S39,000,000
PRINCIPAL AMOUNT OF APACHE JUNCTION, ARIZONA, BONDS; AND
DECLARING AN EMERGENCY.
WHEREAS, the Mayor and City Council of the City of Apache Junction,
Arizona, believe it to be in the best interest of the City to sell S39,000,000
principal amount of Apache Junction, Arizona, Bonds, to include general
obligation bonds and, at the option of the Mayor and City Council, utility
revenue bonds; and
WHEREAS, it is necessary that the Mayor and City Council submit the
question of the issuance and- sale of such bonds to be qualified electors of the
City;
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE
CITY OF APACHE JUNCTION, ARIZONA:
SECTION I
A special bond election in the City of Apache Junction, Arizona, hereinafter
referred to as the "City", is hereby called to be held on November 10, 1987, to
submit to the qualified electors of the City the questions as shown on the form
of ballot attached hereto and marked Exhibit "A".
SECTION II
The election will be called and notice thereof given by posting a copy of the
notice of election mat least five public places in the City and a copy at each
polling place not less than twelve days prior to the date of election and by
publishing a copy of the notice not less than once a week for three successive
weeks in The Mesa Tribune,a newspaper of general circulation in the City.
SECTION III
Notice of the election will be in substantially the form attached hereto,
marked Exhibit "B" and incorporated by reference herein.
SECTION IV
The polling places and the time the polls will open and close will be as
provided in the notice of the election.
SECTION V
The City Clerk is hereby directed to cause ballots to be printed and

delivered to the election boards to be furnished to the qualified electors offering
to vote at the election.
SECTION VI
The election will be conducted and the poll lists kept,and the votes cast
thereat shall be counted and tabulated and the returns thereof will be made in
the manner provided by law and only persons will be allowed to vote at the
election who are qualified electors of the City.
SECTION VII
Absentee voting will be permitted at the election in accordance with the
provisions of Title 16,Chapter 4,Article 8,Arizona Revised Statutes,as
amended.
SECTION VIII
In order to comply with the Voting Rights Act of 1965,as amended,the
following proceedings pertaining to this election will be translated into
Spanish and posted,published and recorded in each instance where posting,
publication and recording of such proceedings are required,to -wit:Notice
of Special Election,Bal lot,all absentee voting material and all instructions
at the polls.
SECTION IX
As soon as the polls are closed,the election officials will canvass
the votes cast,enclose one list of the persons voting and one copy of the
tally sheet in a cover and seal and direct the same to the Mayor and Council
of the City.The Mayor and City Council will meet on November 17,1987,at
7:00 p.m.,which is a day within seven days from the twelfth day after the
election date to canvass the returns of the election.The Mayor and City
Council will be governed by the vote of the majority on the question submitted.
SECTION X
By reason of the urgent need for the improvements to be made from the
proceeds of the bonds herein sought to be authorized,the immediate operation of
the provisions of this resolution is necessary for the preservation of the
public peace,health and safety,and an emergency is hereby declared to exist,
and this resolution will be in full force and effect immediately upon passage
and adoption,and it is so enacted.

Una eleccidn especial de bonos que se llevara el di,.; 10 de
noviembre 1987 en las lugares de votacion:
Que los distritos electorales de los condados de Pinal y Maricopa
se utilicen y que los votantes que residen el los distritos
electorales 22A y 22B del condado de Pinal y el distrito elec-
toral Apache del condado de Maricopa votaran el la escuela
primaria Superstition Mountain, al cruce de Ironwood Drive y
Broadway Avenue, Apache Junction, Condado de Pinal, Arizona;
y que los votantes que residen el los distritos electorales

purificacidri, facilidades de bomba y almacenaje facilidades
de recargar, facilidades de transmision, edificios, facilidades,
equipo, fornituras y cualquier otro propiedad de cualquier clase,
incluyendo co-facilidades que seran utilizadas con otros, para
el sistems de agua, yor compra, construccion o cualquier otro
metodo de adquisicion que sea dentro o fuera los limites corpor-

proclaim and declare that there will be held and conducted an election
in compliance with State Law as follows:.

$17,500,000 to provide funds to acquire by purchase or by eminent
domain the property,plant,facilities,rights or assets of any public
utility company or undertaking rendering water service within or without
the corporate limits of the City;to make improvements,extensions,
additional, renewals, replacements and repairs to the water system of the
City,including land,interests in land,water and rights to the same,
effluent and rights to the same,treatment plants,pumping and storage
facilities,recharge facilities,transmission facilities,buildings,
facilities,equipment,furnishings and any other property of any kind,
including joint facilities to be utilized with others,for the water
system,by purchase,construction or any other method of acquisition,

all legal,financial and other contingent costs in connection with the
acquisition or condemnation of the water system and the issuance of

land,water and rights to the same,effluent and rights to the same,
treatment plants,pumping and storage facilities effluent reuse lines and
facilities,transmission facilities,buildings,facilities,equipment,
furnishing and any other property of any kind,including joint facilities
to be utilized with others,for the sewer system,by purchase,construction
or any other method of acquisition,whether within or without the corporate
limits of the City,and to pay all costs in connection therewith;the bonds,
or any series thereof,to be issued,at the option of the City Council,as
general obligation bonds or as utility revenue bonds payable solely from
the revenues of the utility system of the City,or as tax secured utility

undertaking rendering water service within or without the corporate
limits of the City;to make improvements,extensions,additional,renewals,
replacements and repairs to the water system of the City,including land,
interests in land,water and rights to the same,effluent and rights to
the same,treatment plants,pumping and storage facilities,recharge
facilities,transmission facilities,buildings,facilities,equipment,
furnishings and any other property of any kind,including joint facilities
to be utilized with others,for the water system,by purchase,construction

A qualified elector may vote absentee if:(1)the elector
expects to be absent from the City •on election day;(2)the elector is
physically unable to go to the polls;(3)the elector is 65 years of age
or older;(4)the elector's place of residence is mare than 15 road
miles from the nearest polling place;(5)the elector cannot attend the
polls on election day because of the tenets of his religion;or (6)the
elector is legally blind.Absentee voting material may be obtained by

The Mayor and Council will meet on November 17,1987,at
7:00 p.m.,to canvass the election results.

facilidades de bombeo y almacenaje,facilidades de recarga,facilidades de
transmisidn, edificios, facilidades, equipo, muebles y cualquier otra propiedad de
cualquier tipo, incluyendo facilidades asociadas que se utilizardh con otros, para
el sistema de agua, por compra, construed& o cualquier otro mdtodo de adquisicidn
si dentro o fuera de los 1/mites incorporados de la Ciudad, y; para pagar todos los
gastos legales,financieros y otros costos condicionales en coneccidn con la emisi&
de bonos y en coneccidn Con la adquisici& o expropiaci& de cualquier sistema de
agua; dichos bonos serarn emitados en denominaciones de $1,000 o multiples de eso, y
devengargn interes a una tasa que no excederd 12% por ao, proveyendo que, si
exigido por ley, bonos garantizados por ingresos del sistema de servicios publicos
emitidos con el propdsito de inicialmente adquirir un compromiso de servicios
devengardn inters a tasas cuales podrdn ser fijas o variables pero de ninguna
manera excede 9% por ao, desde la fecha de su emisidn, dicho inters pagadero
semestralmente en el primer d/a de Julio y el primer dfa de enero de cada ao hasta
el vencimiento de cada bono de cada series y dichos bonos se vencerdn durante un
per/odo que no excederd 20 arms desde la fecha de su emisidn de cada series y dichos
bonos se venceran en el primer dia de enero o julio.
Un elector calificado puede votar en ausencfa si:(1) el elector piensa estar
ausente de la Ciudad el dfa de la eleccidn;(2)el elector esta incapacitado
ffsicamente y no puede ir a los lugares de votacion; (3) el elector tiene 65 adios de
edad o mayor;(4) el lugar de residencia del elector esta a ma's de 15 millas por
carretera del lugar de votacidn; (5) el elector no puede ir al lugar de votacidn el
dfa de la eleccion por su credo religioso; o (6) el elector estarlegalmente ciego.
Materiales de votacidn en ausencia se pueden obtener comunicandose con la Oficina
del Secretario de la Ciudad, 1001 North Idaho Road, Apache Junction, Arizona, 85219,

El Alcade y el Concejo Municipal se juntaran el dia. 17 de noviembre, 1987, a las
7:00 p.m. para declarar los resultados de la eleccidn.
