A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY
OF APACHE JUNCTION,ARIZONA,FINDING AND DECLARING THAT
THE ACQUISITION OF ALL OR PART OF THE PROPERTIES,WATER
WORKS,FACILITIES,UTILITY RENDERING WATER SERVICE
AND/OR SEWER SERVICE WITHIN OR WITHOUT THE CORPORATE
LIMITS OF THE CITY OF APACHE JUNCTION WOULD BE
BENEFICIAL TO THE CITIZENS OF SAID CITY,AND ORDERING
THAT THERE SHOULD BE SUBMITTED TO THE VOTERS OF SAID
CITY THE QUESTION AS TO WHETHER OR NOT THE CITY OF
APACHE JUNCTION SHALL BE AUTHORIZED TO UNDERTAKE SUCH
ACQUISITION;AND PROVIDING THE FORM OF BALLOT TO BE
USED AT SAID ELECTION AND DECLARING AND EMERGENCY.
BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF
APACHE JUNCTION,ARIZONA,AS FOLLOWS:
SECTION I:The Mayor and City Council of the -City of Apache
Junction find and declare that the lease or acquisition by purchase,emi-
nent domain,or otherwise,of all or part of the properties,plants,faci-
lities,waterworks,rights,assets,systems,water rights,rights -in -land,
wells,pumping equipment,conduits,pipelines,watermains,hydrants,sewer
lines,and equipment of any public service corporation or public utility
rendering water service and/or sewer service within or without the cor-
porate limits of the City of Apache Junction,and,following such lease or
acquisition,the acquisition,lease,construction and installation of
waterworks,plants,systems,wells,pipelines,sewer lines,pumping equip-
ment,conduits,watermains,hydrants,and other equipment suitable for ren-
dering water service and/or sewer service within or without the corporate
limits of the City would be beneficial to the citizens of the City of
Apache Junction.
SECTION II:The question of whether the City of Apache Junction
shall be authorized to undertake the acquisition,construction,and
installation described in Section I above,is ordered to be put upon the
ballot in substantially the same form as set forth in Exhibit "A"attached
hereto and incorporated herein by reference,at an election to be held on
the 10th day of November,1987,for the purpose of submitting said question
to a vote of the qualified electors who are taxpayers of the City of Apache
Junction.
SECTION III:WHEREAS,the immediate operation of the provisions
of this Resolution is necessary for the preservation of the public peace,
health,and safety,an emergency is hereby declared to exist,and this
Resolution shall be in full force and effect immediately upon passage and
adoption,and i t is so enacted.
