HomeMy WebLinkAboutRES 87-53RESOLUTION NO.87-53 A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,DECLARING THAT CERTAIN DEDICATED RIGHT-OF-WAY DESCRIBED AS THE WEST 15 FEET OF SAN MARCOS DRIVE BETWEEN SUPERSTITION BOULEVARD AND VIRGINIA STREET DESCRIBED IN STREET ABANDONMENT CASE AB -87-08 IS NO LONGER NECESSARY FOR PUBLIC USE AS A ROADWAY AND IS HEREBY VACATED AS PRESENT OR FUTURE PUBLIC RIGHT-OF-WAY. WHEREAS,the requested vacation is a Dedicated right-of-way for public rights -of -way purposes described as a parcel of land located in Section 20, Township 1 North,Range 8 East,Gila and Salt River Base and Meridian,Apache Junction,Pinal County,Arizona,and more particularly described as follows: Parcel 1 All that certain tract or parcel of land lying wholly within a portion of the intersection of the right-of-ways of San Marcos Drive (Vella Drive)and Super- stition Boulevard adjacent to Lots 2 & 4 of Beaty Subdivision as recorded in Book of Maps 9 on Page 40 in the County Recorder's office of Pinal County, Arizona and being more particularly described as follows: Beginning at the Southeast corner of Lot 4 of Beaty Subdivision; Thence North 00 degrees 13 minutes West,along the present West right-of-way line of San Marcos Drive,a distance of 180.04 feet t o the beginning of a tangent curve to the Northwest,said curve has a central angle of 89 degrees and 41 minutes,a radius of 25.00 feet,a tangent di stance of 24.86 feet,and a chord that bears North 45 degrees 03 minutes 30 seconds West, a distance of 35.26 feet; Thence 39.13 feet along said curve to the end of the tangent curve; Thence South 89 degrees 54 minutes East,a distance of 19.86 feet; Thence South 45 degrees 03 minutes 30 seconds East,a distance of 28.36 feet; Thence South 00 degrees 13 minutes East,a distance of 184.80 feet; Thence North 89 degrees 54 minutes West,a distance of 15.00 feet to the Point of Beginning. Parcel 2 The West 15.00 feet of San Marcos Drive right-of-way abutting on the East property line of Lot 6 of Beaty Subdivision as recorded in Book of Maps 9 on Page 40 in the County Recorder's Office of Pinal County,Arizona. Parcel 3 The West 15.00 feet of San Marcos Drive right-of-way abutting along the East property line of Lot 8 of Beaty Subdivision as recorded in Book of Maps 9 on Page 40 in the County Recorder's Office Pinal County,Arizona. RESOLUTION NO.87-53 PAGE ONE OF THREE • Parcel 4 The West 15.00 feet of San Marcos Drive right-of-way abutting on the East property line of Lot 10 of Beaty Subdivision as recorded in Book of Maps 9 on Page 40 in County Recorder's Office of Pinal County,Arizona. Parcel 5 All that certain tract or parcel of land lying wholly within a portion of the intersection of the right-of-ways of San Marcos Drive (Vella Drive)and Virginia Street (Superstition Drive)adjacent to Lots 12,14,16,18 and 20 of Beaty Subdivision as recorded in Book of Maps 9 on Page 40 in the County Recorder's Office of Pinal County,Arizona and being more particularly described as follows: Beginning at the Northeast corner of Lot 12 of Beaty Subdivision; Thence South 89 degrees 54 minutes East,a distance of 15.00 feet; Thence South 00 degrees 13 minutes East,a distance of 455.00 feet; Thence South 44 degrees 56 minutes 30 seconds West,a distance of 28.21 feet; Thence North 89 degrees 54 minutes West a distance of 13.50 feet to the beginning of a tangent curve to the Northeast,said curve has a central angle of 90 degrees 19 minutes,a radius of 18.40 feet,a tangent distance of 18.50 feet,and a chord that bears North 44 degrees 56 minutes 30 seconds East,a distance of 26.09 feet; Thence 29.00 feet along said curve to the end of a tangent curve; Thence North 00 degrees 13 minutes West along the present West right-of-way line of San Marcos Drive,a distance of 456.50 feet to the Point of Beginning. WHEREAS,the vacation requested,i f approved,would not leave a parcel in separate ownership without access to an established public roadway connecting such lands with another public roadway,or have access by a Federally Patented Easement which may in the future be developed;and WHEREAS,the City Council of the City of Apache Junction,Arizona,finds that said Dedicated right-of-way for public rights -of -way purposes as described herein,is classified as a local street on the Apache Junction Street Classification Plan,and is no longer necessary for public use of a roadway; NOW,THEREFORE,BE IT RESOLVED by the Mayor and City Council of the City of Apache Junction,Arizona,that the above -described Dedication reserved for public right-of-way purposes is hereby extinguished and vacated as present or future public rights -of -way. BE IT FURTHER RESOLVED that the vacation of the public right-of-way has no effect on reservations for public utility easements.
