A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE
JUNCTION,ARIZONA,REPEALING RESOLUTION NO.83-66 AS PREVIOUSLY
ADOPTED,AND ADOPTING IN LIEU THEREOF,RESOLUTION NO.87-54,DECLARING
THAT CERTAIN FEDERALLY PATENTED EASEMENTS FOR PUBLIC RIGHTS -OF -WAY
PURPOSES ON NORTH APACHE DRIVE FROM WEST ROUNDUP STREET TO WEST
TEPEE STREET;WEST SHIPROCK STREET FROM 225 FEET WEST OF NORTH
APACHE DRIVE TO NORTH IDAHO ROAD;AND WEST ROUNDUP STREET FROM
NORTH PLAZA DRIVE TO 165 FEET EAST OF NORTH APACHE DRIVE,AS DESCRIBED
IN STREET ABANDONMENT CASE AB -83-21,ARE NO LONGER NECESSARY FOR
PUBLIC USE AS ROADWAYS AND ARE HEREBY ABANDONED AND EXTINGUISHED
AS PRESENT OR FUTURE PUBLIC RIGHTS -OF -WAY.
WHEREAS,Mary Ann Lupo,Merl C.and Lucille H.Lehrkamp,Robert D.
and Gloria L.Copper,John F.Gore,Violet Mesich Stajmiger,Nada M.
Marcetich,Donna Mae Mesich,Shirley R.Knight,Alfred and Norma Jean
Bellucci,E.Kenneth and Elsie V.Ragan,Terry N.Willenburg,Richard N.
Mang,and Edward and Elizabeth Ginsburg have made application for the
abandonment of federally patented easements on the property described
in this Resolution;and
WHEREAS,the requested abandonments are easements for public rights -of-
way purposes described as these parcels of land located in Section 17,
Township 1 North,Range 8 East,Gila and Salt River Base and Meridian,
located in Apache Junction,Pinal County,Arizona,and more particularly
described as follows:
Parcel No.1:
The west thirty-three (33')feet of the north thirty-three (33')
feet of the North i of the Northeast of the Southeast of the
Southeast 24;and
Commencing at the east quarter corner of Section 17,Township 1
North,Range 8 East,Gila and Salt River Base and Meridian,Pinal
County,Arizona;thence south 1319.88 feet along the east line
of said Section 17;thence N89 °50'00W,462.02 feet to the true
point of beginning;thence along a curve to the left 33.63 feet,
said curve having a radius of 50.00 feet,central angle of 38°
32'23"and long chord bearing SOO°46'25"W,33.00 feet;thence
N89°50'00W,164.79 feet;thence NOO° 00'15 114,33.00 feet;thence
S89°50'00"E,165.24 feet to the true point of beginning.

thence SOO°00'15"E,33.00 feet;thence N89°50'16W,272.22 feet;
thence along a curve to the left 61.19 feet,said curve having a radius
of 50.00 feet,central angle of 70°07'18"and long chord bearing N55°
06'05"E,57.45 feet;thence S89°50'16"E,225.11 feet to the true
point of beginning.

WHEREAS,the abandonments requested,i f approved,would not leave
a parcel in separate ownership without access to an established public
roadway connecting such lands with another public roadway,or have access
by a federally patented easement which may in the future be developed;
and
WHEREAS,the City Council of the City of Apache Junction,Arizona,
finds that these said federally patented easements for public rights -of -way
purposes as described herein are classified as local streets on the
Apache Junction Street Classification Plan and are no longer necessary
for public use as roadways;and
WHEREAS,these said easements requested for abandonment have never
been improved as public roadways and maintained by a local governing
agency.
NOW,THEREFORE,BE IT RESOLVED by the Mayor and City Council of
the City of Apache Junction,Arizona,that the above -described federally
patented easements reserved for public rights -of -way purposes are hereby
abandoned and extinguished as present or future public rights -of -way.
BE IT FURTHER RESOLVED,that the abandonment of the public rights -of
way has no effect on reservations for public utility easements.

APACHE JUNCTION,ARIZONA THIS 3RD DAY OF NOVEMBER ,1987 .
