A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE
JUNCTION,ARIZONA,DECLARING THAT CERTAIN FEDERALLY PATENTEND EASEMENTS
AND DEDICATED RIGHTS -OF -WAY DESCRIBED AS GREASEWOOD STREET AND SIESTA
STREET FROM TOMAHAWK ROAD TO VISTA ROAD AS DESCRIBED IN STREET ABANDONMENT
CASE AB -87-05 ARE NO LONGER NECESSARY FOR PUBLIC USE AS A ROADWAYS AND
ARE HEREBY RELINQUISHED AND VACATED AS PRESENT OR FUTURE PUBLIC
RIGHTS -OF -WAY.
WHEREAS,the requested relinquishment of Federally Patented Easement
and vacation for public rights -of -way are described as parcels of land located
in Section 15,Township 1 North,Range 8 East,Gila and Salt River Base and
Meridian,Apache Junction,Pinal County,Arizona;more particularly described
as follows:
Parcel 1 (North 1 of Greasewood Street -Relinquishment of Federally
Patented Easement)
The South thirty-three (33')feet of the Northwest quarter of the Southwest
quarter of the Southwest quarter of Section 15;
EXCEPT the West fifty (50')feet,and
EXCEPT the East thirty-three (33')feet thereof.
Parcel 2 (North 1 of Siesta Street and the South 1 of Greasewood Street
Relinquishment of Federally Patented Easement)
The North thirty-three (33')feet and the South thirty-three (33')feet of
the North half of the Southwest quarter of the Southwest quarter of the
Southwest quarter of Section 15;
EXCEPT the West fifty (50')feet and
EXCEPT the East thirty-three (33')feet thereof.
Parcel 3 (South 1 of Siesta Street - Vacation of Dedicated Right-of-way)
The North thirty-three (33')feet of the South half of the Southwest quarter
of the Southwest quarter of the Southwest quarter of Section 15;and
two 20'by 20'cutoff's described as follows:
Commencing at the Northeast corner of the South half of the Southwest quarter
of the Southwest quarter of the Southwest quarter of Section 15;
Thence West along the North line of the South half,a distance of fifty-three
(53')feet to a point;
Thence South along a line parallel to and fifty-three (53')feet distant to
the East line of South half,a distance of thirty-three (33')feet to the
True Point of Beginning;
Thence East along a line parallel to and thirty-three (33') feet distant to
the North line of the South half,a distance of twenty (20')feet to a point;
Thence South along a line parallel to and thirty-three (33')feet distant
to the East line of the South half,a distance of twenty (20')feet to a point;
Thence proceeding in a Northwesterly direction to the True Point of Beginning;
and

Commencing at the Northwest corner of the South half of the Southwest quarter
of the Southwest quarter of the Southwest quarter of Section 15;
Thence South along the West line of Section 15,a distance of fifty-three
(53')feet to a point;
Thence East along a line parallel to and fifty-three (53') feet distant to
the North line of the South half,a distance of fifty (50') feet to the True
Point of Beginning;
Thence North along a line parallel to and fifty (50')feet distant to the
West line of Section 15,a distance of twenty (20')feet to a point;
Thence East along a line parallel to and thirty-three (33') feet distant to
the North line of the South half,a distance of twenty (20')feet to a point;
Thence proceeding in a Southwesterly direction to the True Point of Beginning.
EXCEPT the West fifty (50')feet and
EXCEPT the East thirty-three (33')feet thereof.
WHEREAS,the abandonment requested,i f approved,would not leave a parcel
in separate ownership without access to an established public roadway
connecting such lands with another public roadway,or have access by a
Federally Patented Easement which may in the future be developed;and
WHEREAS,the City Council of the City of Apache Junction,Arizona,finds
that said Federally Patented Easement and Dedication for public rights -of -way
purposes as described herein,are classified as local streets on the Apache
Junction Street Classification Plan,and are no longer necessary for public
use as roadways;
WHEREAS,said easements requested for relinquishment have never been
improved as public roadways and maintained by a local governing agency.
NOW,THEREFORE,BE IT RESOLVED by the Mayor and City Council of the City
of Apache Junction,Arizona,that the above -described Federally Patented
Easement and Dedication for public right-of-way purposes are hereby
relinquished and vacated as present or future public rights -of -way.
BE IT FURTHER RESOLVED that the relinquishment of Federally Patented
Easements has no effect on reservations for public utility easements.
BE IT FURTHER RESOLVED THAT this resolution shall be adopted with the
stipulation that if the land is not utilized for the proposed project within
a two year period,the roadway abandonments,as specified herein,shall revert
to their original use.

JUNCTION,ARIZONA,THIS 17TH DAY OF NOVEMBER ,1987.
