HomeMy WebLinkAboutRES 87-19RESOLUTION NO.87-19 A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,ARIZONA,DECLARING THAT CERTAIN FEDERALLY PATENTED EASEMENTS AND DEDICATED PUBLIC RIGHTS -OF -WAY PURPOSES DESCRIBED AS A PORTION OF BOWMAN ROAD BETWEEN 16th AVENUE AND U.S.HIGHWAY 60,17th AVENUE AND 18th AVENUE BETWEEN CORTEZ ROAD AND U.S. HIGHWAY 60. DESCRIBED IN STREET ABANDONMENT CASE AB -87-02,ARE NO LONGER NECESSARY FOR PUBLIC USE AS A PRESENT OR FUTURE PUBLIC RIGHTS- OF -WAY. WHEREAS,the requested abandonments and vacations are parcels of land located i n Section 27,Township 1 North,Range 8 East,Gila and Salt River Base and Meridian,Apache Junction,Pinal County,Arizona,and more particularly described as follows: PARCEL No.1 The North thirty-three feet (33'),the South thirty-three feet (33'), and the West thirty-three feet (33')of that portion of the South 1 of the Northeast of the Northeast 1 of the Southwest of Section 27, Township 1 North,Range 8 East,Gila and Salt River Base and Meridian, Pinal County,Arizona lying north of the U.S.Highway 60 right-of-way; EXCEPT the East 40 feet (40')thereof;AND A portion of the South of the Northeast 1 of the Northeast of the Southwest 1 of Section 27 further described as follows: Commencing at the Northwest corner of the South 1 of the Northeast 1 of the Northeast 1 of the Southwest of Section 27;thence east along the North line of the South of the Northeast 1 of the Northeast 1 of the Southwest a distance of fifty-three feet (53')to a point; thence south along a line parallel to and fifty-three feet (53')distant to the West line of the South 1 of the Northeast 1 of the Northeast of the Southwest /a distance of thirty-three feet (33')to the TRUE POINT OF BEGINNING;thence west along a line parallel to and thirty-three feet (33') distant to the north line of the South of the Northeast 1 of the North- east 1 of the Southwest 1 a distance of twenty feet (20')to a point; thence south along a line parallel to and thirty-three feet (33')distant to the West line of the South 1 of the Northeast of the Northeast of the Southwest 1 a distance of twenty feet (20')to a point;thence proceeding in a northeasterly direction to the TRUE POINT OF BEGINNING; AND A portion of the South 1 of the Northeast 1 of the Northeast /of the Southwest 1 of Section 27 further described as follows: Commencing at the Northeast corner of the South 1 of the Northeast of the Northeast of the Southwest /of Section 27;thence west along the North line of the South 1 of the Northeast 1 of the Northeast 1 of the Southwest 1 a distance of sixty feet (60')to a point;thence South along a line parallel to and sixty feet (60')distant to the East line of the Southwest i ,a distance of thirty-three feet (33')to the TRUE POINT OF BEGINNING;thence east along a line parallel to and thirty- three feet (33')distant to the North line of the South 1 of the Northeast i of the Northeast i of the Southwest i a distance of twenty feet (20')to a point;thence south along a line parallel to and forty feet (40')distant to the East line of the Southwest 1 a distance of twenty feet (20')to a point thence proceeding i n a northwesterly direction to the TRUE POINT OF BEGINNING;AND A portion of the South if of the Northeast 1 of the Northeast 1 of the South- west 1 further described as follows: RESOLUTION NO.87-19 PAGE TWO Commencing at the Southeast corner of the South of the Northeast /of the Northeast of the Southwest 1 of Section 27;thence west along the South line of the South of the Northeast 1 of the Northeast 1 of the Southwest 1 a distance of sixty feet (60')to a point;thence north along a line parallel to and sixty feet (60')distant to the East line of the Southwest 1 a distance of thirty—three feet (33')to the TRUE POINT OF BEGINNING;thence east along a line parallel to and thirty—three feet (33')distant to the South line of the South I-of the Northeast 1 of the Northeast 1 of the Southwest 1 a distance of twenty feet (20')to a point; thence North along a line parallel to and forty feet (40')distant to the East line of the Southwest 1 a distance of twenty feet (20')to a point; thence proceeding in a Southwesterly direction to the TRUE POINT OF BEGINNING. PARCEL No.2 The east thirty—three feet (33')of the North of the Northwest 1 of the Northeast of the Southwest 1 of Section 27,Township 1 North,Range 8 East,Gila and Salt River Base and Meridian,Pinal County,Arizona;EXCEPT the North 40'thereof;AND A portion of the North of the Northwest 1 of the Northeast 1 of the South— west 1 of Section 27,Township 1 North,Range 8 East,Gila and Salt River Base and Meridian,Pinal County,Arizona,further described as follows: Commencing at the northeast corner of the Northwest 1 of the Northeast 1 of the Southwest 1 of said Section 27;thence south along the east line of the Northwest 1 of the Northeast of the Southwest a distance of sixty feet (60')to a point;thence west along a line parallel to and sixty feet (60') distant to the north line of the Northwest 1 of the Northeast 1 of the South— west a distance of thirty—three (33')to the TRUE POINT OF BEGINNING; thence north along a line parallel to and thirty—three feet (33')distant to the east line of the Northwest 1 of the Northeast 1 of the Southwest 1,a distance of twenty feet (20')to a point;thence west along a line parallel to and forty feet (40')distant to the north line of the Northwest 1 of the Northeast 1 of the Southwest 1,a distance of twenty feet (20')to a point; thence proceeding in a southeasterly direction to the TRUE POINT OF BEGINNING. PARCEL No.2A The South thirty—three feet (33')of the North 1 of the Northwest of the Northeast of the Southwest of Section 27,Township 1 North,Range 8 East,Gila and Salt River Base and Meridian,Pinal County,Arizona.Lying Northeasterly of the Northerly right of way line of U.S.Highway 60. PARCEL No.3 The West thirty—three (33')and the South thirty—three (33')of the North I-of the Northeast of the Northeast 1 of the Southwest 1 of Section 27, EXCEPT THE North forty feet (40')AND EXCEPT the East forty feet (40')thereof. PARCEL No.4 The North thirty-three feet (33')and the East thirty-three feet (33') of the South 1 of the Northwest I of the Northeast 1 of the Southwest 1 of Section 27,lying Northeasterly of the northerly right of way line of U.S.Highway 60. PARCEL No.5 The North thirty-three feet (33')of the North 1 of the Southeast of the Northeast 1 of the Southwest 1 of Section 27,lying Northeasterly of the northerly right of way line of U.S.Highway 60. EXCEPT the East forty feet (40'). RESOLUTION NO.87-19 PAGE THREE I I WHEREAS,the abandonment requested,i f approved,would not leave a parcel i n separate ownership without access to an established public roadway connecting such lands with another public roadway,or have access by a Federally Patented Easement which may in the future be developed;and WHEREAS,the City Council of the City of Apache Junction,Arizona,finds that said Federally Patented Easements and Dedications for public rights- of -way purposes as described herein,are classified as local streets on the Apache Junction Street Classification Plan,and are no longer necessary for public use as roadways;and WHEREAS,said easements and dedications requested for abandonment have never been improved as public roadways and maintained by a local governing agency. NOW,THEREFORE,BE IT RESOLVED by the Mayor and City Council of the City of Apache Junction,Arizona,that the above -described Federally Patented Easements and Dedications reserved for public rights -of -way purposes are hereby abandoned and extinguished as present or future public rights -of -way. BE IT FURTHER RESOLVED that the abandonment and vacation of the public rights -of -way has no effect on reservations for public utility easements.
