A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF
APACHE JUNCTION,ARIZONA,STATING THE CITY COUNCIL'S INTENT
TO ACQUIRE WATER COMPANIES SERVICING THE CITY OF APACHE
JUNCTION,ARIZONA,DIRECTING THE PREPARATION OF A RESOLUTION
IN ACCORDANCE WITH A.R.S.SECTION 9-524 PERTAINING TO THE
ISSUANCE OF BONDS FOR THE PURCHASE OF SAID WATER COMPANIES;
AND AUTHORIZING NEGOTIATION FOR SERVICES OF CONSULTANTS
PERTAINING TO THE ISSUANCE OF SAID BONDS.
WHEREAS,the Mayor and City Council of the City of Apache Junction,
Arizona,on several prior occasions,have discussed the necessity of a utility
undertaking by the City of Apache Junction,more specifically relating to the
provision of a water service for the citizens of Apache Junction,and
WHEREAS,the Mayor and City Council of the City of Apache Junction,
are of the opinion that there is a necessity to state their intent to acquire
the facilities of those companies presently providing service to the City of
Apache Junction,Arizona and
WHEREAS,the Mayor and City Council of the City of Apache Junction,
Arizona,desire to give formal direction to the City Manager,the City Attorney,
and Bill Stephens and Associates,P.C.a law firm retained to advise the Mayor
and City Council on matters of water and sewer service.
THEREFORE,BE IT RESOLVED BY the Mayor and City Council of the City
of Apache Junction,Arizona,that by this Resolution said Mayor and City Council
hereby formally express their intent to acquire by emminent domain the facilities
of those water companies presently providing water service to the citizens of
Apache Junction,both within and without of the City's corporate limits;namely,
the Arizona Water Company and Consolidated Water Company (Palm Springs);and
BE IT FURTHER RESOLVED BY the Mayor and City Council of the City of
Apache Junction,Arizona,that i t is the City Council's intention to hold a
bond election i f the feasibility studies indicate that i t is in the public's
interest to do so;and
BE IT FURTHER RESOLVED BY the Mayor and City Council of the City of
Apache Junction,Arizona,that the City Manager,City Attorney and Bill Stephens
and Associates,P.C.prepare all necessary resolutions including a resolution in
accordance with A.R.S.Section 9-524,calling an election upon the question
of issuance of bonds to provide funds for the purchase of said water service
and further authorizing said individuals to take such action so that emminent
domain proceedings may be legally commenced at the earliest convenient date;
and
BE IT FURTHER RESOLVED that the City Manger,City Attorney,and Bill
Stephens and Associates,P.C.be specifically authorized to consult with and
recommend the retention of a bond consultant,bond attorney,or such other
consultants as are necessary in order to properly initiate the previously
stated emminent domain proceedings.
