HomeMy WebLinkAboutRES 87-30RESOLUTION NO.87-30 A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,SETTING FORTH ITS INTENT TO APPROVE THE INTERGOVERNMETNAL AGREE— MENT BETWEEN THE COUNTY OF MARICOPA AND THE CITY OF APACHE JUNCTION FOR THE INSTALLATION OF TRAFFIC SIGNALS AT SUPERSTITION BOULEVARD (UNIVERSITY DRIVE)AND MERIDIAN DRIVE,AND AUTHORIZING AN EXPENDITURE OF AN AMOUNT NOT TO EXCEED $92,000 FOR THE CITY'S SHARE OF CONSTRUCTION COSTS AND APPROVAL OF PAYMENT OF MONTHLY ELECTRICAL CHARGES FOR SAID TRAFFIC SIGNAL INSTALLATION. WHEREAS the_City-believes i t is in the best interest for the public safety and welfare to improve the street intersection and install traffic signals in the location of Superstition Boulevard (University Drive)and Meridian Drive;and WHEREAS Maricopa County has tendered an intergovernmental agreement with the City's share for construction costs estimated to be an amount not to exceed $92,000 with the City of Apache Junction incurring monthly electrical charges when traffic signal i s activated. NOW,THEREFORE,BE IT RESOLVED that the City Council of Apache Junction, Arizona,approves and accepts the construction intergovernmental agreement between the County of Maricopa and the City of Apache Junction,and payment of monthly electrical charges for said traffic signal when activated. SIGNED AND ATTESTED TO THIS 17th DAY OF JUNE ,1987. / ,1 Z4' ATTEST: 7/4 4 4 Kathleen Connelly,City Cler APPROVED AS TO FORM: Alex City Attorney Norman S.Hill,Mayor INTERGOVERNMENTAL AGREEMENT BETWEEN MARICOPA COUNTY AND THE CITY OF APACHE JUNCTION UNIVERSITY DRIVE - MERIDIAN ROAD INTERSECTION THIS AGREEMENT entered into this of ,1987,pursuant t o Arizona Revised Statutes Sections 11-951 through 11-95 11,by and between the County of Maricopa,a political subdivision of the State of Arizona hereinafter called "COUNTY,"and the CITY OF APACHE JUNCTION,a municipal corporation,hereinafter called "CITY." WHEREAS,the CITY,pursuant to Arizona Revised Statutes Section 9-2140(b)(3)has the authority to repair and improve streets within its corporate limits;and WHEREAS,the COUNTY,pursuant to Arizona Revised Statutes Section 11-251(4)and 18-208,has the authority to improve streets within or without the corporate limits of a city or town;and WHEREAS,the COUNTY proposes to improve University Drive at Meridian Road of which a portion of the improvements are within the CITY; and WHEREAS,the CITY i s willing to participate in the improvement project pursuant t o Arizona Revised Statutes;and jointly exercise common powers pursuant t o Arizona Revised Statutes;Title 11,Chapter 7, Article 3; WHEREAS, for the safety, protection and convenience of the traveling public, it is necessary and desirable that an Agreement be entered into for the construction, operation and maintenance of a traffic signal system at the intersection of University Drive and Meridian Road;and NOW, THEREFORE, in consideration of the mutual covenants hereinafter set forth, the parties mutually agree to the following: 1.The COUNTY shall: a.Be responsible for all surveys, all necessary engineering work and all plans and specifications for the roadway improvement and signalization except the plans already prepared by Hook Engineering for the Circle K store at the southeast corner.The COUNTY'S plans shall match the plans for the Circle K at the roadway centerline. b.Act as the contracting agency for the project and shall call for, receive, open and tabulate bids for the proposed improvement. c.Provide all the necessary construction engineering, interim and final inspections and testing required for quality control and adherence to the plans and specifications; and in addition, the CITY shall also participate in the final inspection to determine whether the COUNTY. and CITY shall jointly accept the project construction. d.Make the installation of the above ground portions of the traffic signal and furnish material, labor and equipment to the value of one-half signalization costs. e.Operate and provide routine maintenance on the traffic signal until such time, by mutual written agreement, it is no longer necessary or desirable, or until relieved of responsibility by annexation. f.Furnish all labor, tools and construction equipment necessary to replace damaged or defective materials and apparatus, and when deemed necessary and with the approval of the CITY, install additional apparatus as may be required on the CITY right-of-way. g.Provide sufficient funds each year necessary for the complete maintenance of the said installation. h.Keep detailed maintenance records. I.In the event of any future COUNTY initiated construction projects involving the above -referenced intersection, the project plans shall include all details for the relocation and/or modification of any or all signal and/or illumination equipment within the CITY and such plans shall be submitted to the CITY for approval. All costs of this work shall be at the COUNTY's expense. j.Any proposed modifications of traffic signals and/or highway lighting located on the CITY street shall be based on and supported by traffic studies.All proposed modifications shall be submitted to the CITY for apprc,va: . k.Pssume full responsibility for the installation of temporary traffic control devices, public safety and convenience during construction of this facility. 1.COUNTY funds for the construction, maintenance and operation of this traffic signal shall come from budgeted Highway Department revenues.All major materials will be purchased through competitive bidding. 2.The CITY shall: a.Acquire all necessary rights -of --way within its own jurisdiction prior to the call for bids. b.Furnish and pay monthly electrical changes for the traffic signal and luminaires and the costs for the multi -use pole installed by Salt River Project northeast corner. c.In future major CITY initiated construction projects on the COUNTY system at this intersection the project plan shall include all details for the relocation and/or modification of any or all signal and/or illumination equipment, and such plans shall be submitted to the COUNTY for its approval.All costs of such work shall be at the CITY's expense. d.Upon completion of project, agree to resume maintenance responsibilities (including signing and striping) for that segment within its jurisdiction.Initial pavement striping shall be a part of the construction project. e.Within thirty (30) days after written notification of completion and after COUNTY's and CITY's acceptance of the project construction within their respective jurisdictions, reimburse the COUNTY for the CITY's share of construction, which shall be the cost of all improvements lying east of the Meridian Road section line (Pinal County line) except those improvements already installed as part of the Circle K project. The CITY also agrees to reimburse the Maricopa County Highway Department in materials, traffic signal equipment or money for said signalization, with costs not to exceed $12,000 or one-half the cost of above -ground installation whichever is less. Costs shall be computed on the basis of contract unit prices bid on the COUNTY project for this work, Work Order No. 47260, as outlined in Exhibits A and B. 3.The COUNTY agrees to indemnify, save harmless and defend the CITY from all suits, actions or claims of any character brought against the CITY because of any injury or damage to any person or property caused by the COUNTY in any of its activities or performance under this contract. The CITY agrees to indenmify, save harmless and defend the COUNTY from all suits, actions or claims of any character brought against the COUNTY because of any injury or damage to any person or property caused by the CITY in any of its activities or performance under this Agreement. 4.It is understood by both parties hereto that upon the termination of this Agreement for any cause whatsoever, all traffic signal system hardware components are declared to be property of the COUNTY, unless annexed by the CITY. 5.This Agreement shall become effective as of the date it is filed with the Maricopa County Recorder pursuant to Arizona Revised Statutes Section 11-952, and remain in full force and effect until one of the parties terminates the Agreement. Termination shall be made by giving the other party written notice no less than thirty days prior to the effective date of termination. 6.Attached to this Agreement are copies of appropriate action by ordinance,resolution or otherwise authorizing the respective parties to enter into this Agreement. MARICOPA COUNTY CITY OF APACHE JUNCTION By Chairman, Board of Supervisors ATTEST: By Mayor ATTEST: By By Clerk of the Board City Clerk APPROVAL OF COUNTY AND CITY ATTORNEY I hereby state that I have reviewed the proposed Intergovernmental Agreement, between the County of Maricopa, and the City of Apache Junction, and declared the Agreement to be in proper form and within the powers and authority granted to their respective governing bodies under the laws of the State of Arizona. 1) De4ty County Attorney City Attorney I/ Date //Date EXHIBIT A DESIGN FEATURES FOR MERIDIAN ROAD AND UNIVERSITY DRIVE INTERSECTION ACCORDING TO PLANS BEING PREPARE BY MARICOPA COUNTY HIGHWAY DEPAR'TMENT AND DESIGNATE AS PROJECT NO. 47260 The southwest, northwest and northeast corners shall have vertical curb returns with 5—foot sidewalk behind the returns and a wheelchair ramp at each location. The west leg shall be paved for a distance of approximately 1100 feet. The north leg shall be paved for 300 feet.The east leg shall be paved for 200 feet.The south leg shall be paved for 350 feet with curb on the west side. All new pavement shall taper into the existing roadway at appropriate rates (generally 50:1). The pavement structure shall be 2 1/2 inches of asphaltic concrete over 9 inches of aggregate base course (ABC). Traffic signals shall be installed including poles, conduit and pull boxes. ECHIBIT B COST ESTIMATE AND COST SHARING FOR UNIVERSITY DRIVE/MERIDIAN ROAD INTERSECTION MARICOPA COUNTY HIGHWAY DEPARTMENT PROJECT NUMBER 147260 The Engineer's estimate for the cost of construction is $110,000.The actual costs shall be the prices bid by the successful contractor when sealed bids are opened and tabulated. The estimated cost sharing is expected to be approximately as follows: Maricopa County share -70%of $110,000 =$77,000 Apache Junction share - 30% of $110,000 plus maximum of $12,000 for signal equipment (see paragraph 2e) =$45,000
