HomeMy WebLinkAboutRES 88-03RESOLUTION NO.88-03 A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,ARIZONA,DECLARING THAT PORTIONS OF CERTAIN FEDERALLY PATENTED EASEMENTS AND DEDICATED RIGHTS -OF -WAY DESCRIBED AS THE NORTH EIGHT (8')FEET OF SIXTH AVENUE FROM CORTEZ ROAD TO BOWMAN ROAD AS DESCRIBED IN STREET ABANDONMENT CASE AB -88-01,ARE NO LONGER NECESSARY FOR PUBLIC USE AS ROADWAYS AND ARE HEREBY RELINQUISHED AND VACATED AS PRESENT OR FUTURE PUBLIC RIGHTS -OF -WAY. WHEREAS,the requested relinquishment of Federally Patented Easement and Vacation for public rights -of -way are described as parcels of land located in Section 22,Township 1 North,Range 8 East,Gila and Salt River Base and Meridian,Apache Junction,Pinal County,Arizona,and more particularly described as follows: Parcel 1 -(The North 8'of 6th Avenue -Relinquishment of Federally Patented Easement) The North eight (8')feet of the South thirty-three (33')feet of the Southeast quarter of the Northeast quarter of the Southeast quarter of the Southwest quarter of Section 22; EXCEPT the East forty (40')feet thereof. Parcel 2 -(The North 8'of 6th Avenue -Relinquishment of Federally Patented Easement) The North eight (8')feet of the South thirty-three (33')feet of the West half of the Southwest quarter of the Northeast quarter of the Southeast quarter of the Southwest quarter of Section 22; EXCEPT the West thirty-three (33')feet thereof. Parcel 3 -(The North 8'of 6th Avenue -Vacation of Dedicated Right-of-way) The North eight (8')feet of the South thirty-three (33')feet of the East half of the Southwest quarter of the Northeast quarter of the Southeast quarter of the Southwest quater of Section 22. WHEREAS,the abandonment requested,if approved,would not leave a parcel in separate ownership without access to an established public roadway connecting such lands with another public roadway,or access by a Federally Patented Easement;and WHEREAS,the City Council of the City of Apache Junction,Arizona, finds that said Federally Patented Easements and Dedication for public rights -of -way purposes as described herein,are classified as local streets on the Apache Junction Street Classification Plan,of which a portion is no longer necessary for public use as a roadway. Resolution No.88-03 Page 1 of 2 • NOW,THEREFORE,BE IT RESOLVED by the Mayor and City Council of the City of Apache Junction,Arizona,that the above -described portions of Federally Patented Easement and Dedication for public right-of-way purposes are hereby extinguished as present or future public rights -of -way. BE IT FURTHER RESOLVED that the abandonment of the public rights -of -way has no effect on reservations for public utility easements.
