A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,
ARIZONA,DECLARING THAT THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE
JUNCTION SUPPORTS THE POSITION OF THE PETITIONS SIGNED BY THE RATE PAYERS
AND PROPERTY OWNERS IN THE AMERICAN PUBLIC SERVICE COMPANY LICENSED SEWER
FACILITY AREA.
WHEREAS,the rate payers within the American Public Service Company licen-
sed areas of Apache Junction have petitioned governmental and regulatory agen-
cies to resolve problems regarding the American Public Service sewage faci-
lities;and
WHEREAS,the City of Apache Junction has observed an apparent lack of
operation and maintenance which has resulted in frequent and continuing obno-
xious odors of varying degrees;and
WHEREAS,the lack of completed improvements continue to leave existing
facilities overloaded to the extent that required treatment standards are not
being attained;and
WHEREAS,certain property within the American Public Service Company's
licensed area remains undeveloped due to an apparent lack of plant capacity;
and
WHEREAS,the State and the City will not permit the addition of new units
due to the current condition of existing facilities;and
WHEREAS,the facilities area is unkempt and cluttered with weeds and
stored used equipment which creates a blight on the community image;and
WHEREAS,the City has lost potential revenue due to the lack of new build-
ing and development in the licensed area;and
WHEREAS,American Public Service is primarily regulated by the Arizona
Corporation Commission and must comply with requirements of the Arizona Depart-
ment of Environmental Quality for operation,maintenance and construction of
facilities as well as local requirements for zoning and building.
THEREFORE,BE IT RESOLVED that the Mayor and City Council of the City
of Apache Junction supports the position of the rate payers and property owners
as outlined in their petition and appeals to the Governor of the State of
Arizona,Arizona Corporation Commission,State Department of Environmental
Quality,State Attorney General,Pinal County Health Department,and American
Public Service Company to bring facilities into compliance and meet all
requirements and demands for existing and future conditions.
