A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,
ARIZONA,SETTING FORTH ITS INTENT TO APPROVE THE INTERGOVERNMENTAL
AGREEMENT BETWEEN THE COUNTY OF MARICOPA AND THE CITY OF APACHE JUNCTION
FOR THE CONSTRUCTION OF THE INTERSECTION AT SOUTHERN AVENUE AND MERIDIAN
DRIVE AND ONE -QUARTER MILE OF MERIDIAN DRIVE..
WHEREAS the City believes i t is in the best interest for the public safety
and welfare to improve the street intersection at Southern Avenue and Meridian
Drive;and
WHEREAS Maricopa County has tendered an intergovernmental agreement which
indicates that the City's portion of the construction will be furnishing the
labor and equipment required to complete the project.
NOW,THEREFORE,BE IT RESOLVED that the City of Apache Junction,Arizona,
approves,and accepts the construction intergovernmental agreement between the
County of Maricopa and the City of Apache Junction.
PASSED AND ADOPTED by the Mayor and City Council of the City of Apache
Junction,Arizona,this 5TH day of SEPTEMBER ,1989.

INTERGOVERNMENTAL ASEEMENT
BETWEEN
MARICOPA COUNTY
AND
CITY OF APACHE JUNCTION

This agreement entered into this day of , 1989,
by and between the COUNTY OF MARICOPA, a political subdivision of the
State of Arizona (hereinafter called the "COUNTY") and the CITY OF
APACHE JUNCTION, a municipal corporation (hereinafter called "CITY").
WHEREAS, the County is constructing Southern Avenue between
Ellsworth Road and Meridian Road, and
WHEREAS, Meridian Road north of the Southern Avenue intersection
is a dirt road for approximately 1/11 mile which lies on the line
between the County and the City with one half of the road being in
each jurisdiction, and
WHEREAS, the County desires to provide a paved exit to the newly
constructed Southern Avenue and the City approves of such paving, and
WHEREAS, ABS 11-952 provides for intergovernmental agreements
between public agencies for joint or cooperative projects.
NOW, THEREFORE, in consideration of the mutual covenants and
promises as hereinafter set forth, the parties agree to the following:
1. Meridian Road for approximately 1/4 mile north of it's
intersection with Southern Avenue shall be improved to a 28 -foot
surfaced road with 2-1/2 inches of asphaltic concrete placed on a 9
inch ABC base, including the full intersection with 35 -foot radii to
the west.
2.Each party will furnish the right-of-way at a minimum 33 feet
wide for that portion of the road laying within it's jurisdiction.
3. The County will obtain the permission of Final County to pave
the southeast quadrant of the intersection, and will insure that Pinal
County has the right-of-way within this area.
4.The County will perform the preliminary surveys and provide a
grade line for the paving work.
5.The County will furnish all materials required for the
construction.
6. The City will furnish all labor and equipment required to
complete the construction.
7.The County will furnish the grade stakes necessary for the
construction.
8.All materials and construction will be in accordance with
Maricopa Association of Governments Standard Specification for Public
Works Construction.
This agreement shall remain in full force and effect until all work is
completed as prescribed herein.
This agreement has been approved by the actions of both governing
bodies of the County and the City.In such respective actions, the
undersigned are authorized and directed to execute this agreement.
This agreement shall become effective on the date it is filed in the
office of the Secretary of State of the State of Arizona.
