Public hearings required by applicable law shall be conducted by the council and any person shall be

the mayor. This time limitation shall not apply to applicants and their agents appearing before the council.

M. CALL TO PUBLIC
At this time the public has the privilege to address the council with requests, communications, comments
or suggestions relating to city business.All speakers must have already submitted a written "Request to
Speak"form to the city clerk no later than the conclusion of the city manager's report portion of the
agenda. If there is a group speaking on the same item, they should select a spokesperson.All such
remarks shall be addressed to the council as a whole and not to any member thereof. The mayor is
authorized to ask a speaker to stop speaking and leave the podium or to adjourn the meeting if anyone
becomes disorderly, uncivil, makes personal attacks or continues to speak about items that are not
within the jurisdiction of the city after being warned such issues are beyond the jurisdiction of the city to
act. The council may not answer questions of the speaker, discuss the matter with one another, but may,

Councilmember Soller read the proclamation designating the week of April 14-20, 2024, as
"National Public Safety Telecommunications Week"and presented it to Assistant Chief of Police
Johnny John and Communications Manager Jessica Kelley.
6. Proclamation designating April 2O' 2O24, an "National Arbor Oey."
Mayor Wilson read the proclamation designating April 26, 2024, as"National Arbor Day"and
presented it to Parks Superintendent David Butler and Recreation Coordinator Jared Grimm.
Mr. Butler stated the City's application to be a tree city was approved so the Parks and
Recreation department is focusing on more arbor training and expanding their tree canopy.
7. Proclamation designating the week of May 5 - 11, 2024, as "Professional
Municipal Clerks Week."
Mayor Wilson read the proclamation designating the week of May 5- 11, 2024, as"Professional
Municipal Clerks VVeek.^ City Clerk Jennifer Pena, Business License Coordinator Donna
Scruggs and Records Coordinator Dana Tucker accepted the proclamation. Ms. Pena shared
the history of the clerks office and the role it plays in local government. She also complimented
her staff for their hard work.

Villages Month."
Vice Mayor Schroeder read the proclamation designating the month of May as"National Cities,
Towns and Villages Month" and presented it to Assistant City Manager Matt Busby.

Councilmember Heck and Mayor Wilson attended the grand opening for Agave Ridge Behavorial
Hospital on April 11, 2024, in Mesa. They provide inpatient care for adolescents and adults who
are struggling with addictions and mental health disorders. They are hoping to work with the
Apache Junction police and serve residents of the city. Councilmember Heck also highlighted
the drones that the Apache Junction Police Department use and their effort to recover a
Mounted Ranger's horse that got loose during Lost Dutchman Days.
Councilmember Soller attended the Earth Day Celebration on April 6, 2024, at Horizon Health
and Wellness. He met with the master gardener and commented on how great the event was.
He also set up a tour of the Real-Time Crime Center in Mesa for councilmembers and select
city employees.
Mayor Wilson shared that he was impressed by the Real-Time Crime Center Tour. He stated
that he attended the East Valley Mayors Prayer breakfast on April 16, 2024, at the Talking Stick
Gold Club,which highlighted STARS and Civitan Foundation. He also attended a ground
breaking at Phoenix Mesa Gateway Airport for XNRGY Climate Systems, a North American
leader in sustainable HVAC solutions. The facility is expected to open early 2025 and create
over 900 new jobs.
Councilmember Cross commented on the ground breaking for XNRGY Climate Systems and
how large the building will be and the amount of construction jobs it will create.
G. CITY MANAGER'S REPORT
10. 24-242 City Manager's Report.
City Manager Bryant Powell announced a process improvement for the Human Resources
department. They have upgraded the software for applying for jobs with the city to NeoGov. He
also shared the Battle of the Badge baseball game is on April 20, 2024 at 9:00 AM at Prospector
Park. The Apache Junction Police department will take on the Superstition Fire and Medical
District for bragging rights.

12. 24-245 Public hearing and consideration on the Fifth Amendment to the Economic
Development Agreement between City of Apache Junction and Mehmood
Mohiuddin as owner of the Hitching Post.
Councilmember Soller moved,seconded by Vice Mayor Schroeder that the Fifth Amendment to
the Hitching Post Development Agreement be approved.

M. CALL TO PUBLIC
George Schroeder, 2444 W. Virginia Street, Apache Junction, stated he attended the Apache
Junction Homeless Coalition meeting and had a negative experience with a previous City
employee. He is upset about being the bad guy with City Council and asked why his neighbor
received so much help from the City for her new home.
Catherine Meek, 1327 S. Belair Road, Apache Junction, announced that April 19, 2024, is World
Liver Day, and explained that liver disease is now happening to younger people and children due
to diet. She recommended eating a non-fried food diet with no high fructose corn syrup and be
mindful of some medicines that are harmful to the liver.
Donna Carr, 2178 W.Virginia Street, Apache Junction, spoke about the amount of signatures
she has received for petitions to not allow more mental health facilities in her neighborhood and
to stop using reclaimed water in the City. She only went to 3 neighborhoods near her home and
received hundreds of signatures. She will turn those over to the City Clerk.
Andre Meek, 1327 S. Belair Road, Apache Junction, addressed the globe chamomile weed
issue that has taken over an alley near his home. They cannot be sprayed as they will grow
back so there needs to be a city effort to help get rid of them.

SUBJECT: Utilization of Unobligated Federal Funds
PWC2021-04 Delaware Drive Roadway Improvement Project
REQUEST
The City pursued additional federal funds for bicycle and pedestrian improvements on Delaware Drive
from 16th Avenue to Broadway Avenue in 2023 due to the construction cost increase during design.
BACKGROUND
Maricopa Association of Governments (MAG) attempts to utilize all of the spending authority made
available to the region. To meet this goal, MAG established a closeout process. The most important
criteria for a Closeout project is that it must have completed the federal project development process
through a self-certified agency (ADOT) and be in a position to go to bid by the end of the current federal
fiscal year (June 1 st). Closeout priorities are to advance a current federally funded programmed project
that are ready to be obligated, second is to increase the federal share of projects being obligated, then
street sweepers, and lastly design.

The Public Works Department is requesting City Council approval to enter into an Intergovernmental
Agreement (IGA) Amendment with ADOT which will provide additional federal funds to cover the
increased construction costs for the pedestrian improvements of Delaware Drive in the amount of

RESOLUTION NO. 24-04
A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF
APACHE JUNCTION, ARIZONA, AUTHORIZING THE CITY TO ENTER
INTO AMENDMENT NO. ONE TO THE INTERGOVERNMENTAL AGREEMENT
WITH THE STATE OF ARIZONA FOR THE DELAWARE DRIVE, 16TH AVE
TO BROADWAY AVE PEDESTRIAN IMPROVEMENT PROJECT.
WHEREAS, on June 8, 2021 the City of Apache Junction
("City") and the State of Arizona Department of Transportation
("ADOT") entered into an Intergovernmental Agreement ("IGA") for
a pedestrian improvement project on Delaware Drive between 16tn
and Broadway Avenues (the "Project") ; and
WHEREAS, the City recently received, through the Maricopa
Association of Governments ("MAG") , additional federal funds to
cover the increased construction costs since 2021; and
WHEREAS, the attached written amendment (%NIGA/JPA 21-
0008125-I, Amendment No. One : 24-0009578-I") modifies the
original financial and administrative conditions for
construction of the Project, which takes into account the
available MAG funds .
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY

THIS AMENDMENT NO.ONE to INTERGOVERNMENTAL AGREEMENT (the"Amendment No.
One"),is entered into this date ,pursuant to Arizona Revised Statutes
("A.R.S.") §§ 11-951 through 11-954,as amended,between the STATE OF ARIZONA,acting by and
through its DEPARTMENT OF TRANSPORTATION (the"State" or"ADOT") and the CITY OF APACHE
JUNCTION,acting by and through its MAYOR and CITY COUNCIL (the"City").The State and the City
are each individually referred to as a"Party"and are collectively referred to as the"Parties."
WHEREAS,the INTERGOVERNMENTAL AGREEMENT,IGA 21-0008125-I,A.G. Contract No.
P0012021000600,was executed on June 8, 2021, (the"Original Agreement");
WHEREAS,the State is empowered by A.R.S.§28-401 to enter into this Amendment No. One and
has delegated to the undersigned the authority to execute this Amendment No.One on behalf of the
State;
WHEREAS,the City is empowered by A.R.S.§48-572 to enter into this Amendment No. One and has
by resolution,if required,a copy of which is attached and made a part of,resolved to enter into this
Amendment No.One and has authorized the undersigned to execute this Amendment No. One on
behalf of the City; and
NOW THEREFORE,in consideration of the mutual terms expressed herein,the purpose of
this Amendment No. One is to increase the Project costs; Exhibit A is revised and replaced
accordingly.The Parties desire to amend the Original Agreement,as follows:

I. RECITALS
Section I,Paragraph 3 is revised,as follows:
3. The work proposed under this Agreement consists of pedestrian improvements along
Delaware Drive from 16tnAvenue to Broadway Avenue, (the"Project").The Project includes
sidewalks,curb and gutter on the west side,shared turning lane,bicycle lanes,and street
lights.The Project cost is estimated at$6,709,662,as shown in Exhibit A,which includes
federal aid and the City's match.The State will administer the design,advertise,bid and
award,and administer the construction of the Project.
IL SCOPE OF WORK
Section II,Paragraph 2.e.is revised,as follows:
2. The State will:
e. After completion of design and prior to bid advertisement,invoice the City for the actual
PDA costs,as applicable,and the City's share of the Project construction costs,estimated
at$354,067.After the Project costs for construction are finalized,the State will either
invoice or reimburse the City for the difference between estimated and actual costs.
Deobligate or otherwise release any remaining federal funds from the scoping/design
phase of the Project.
Section II,Paragraph 3.d.is revised,as follows:
3. The City will:
d. After completion of design,within 30 days of receipt of an invoice from the State and
prior to bid advertisement,pay to the State,any outstanding PDA costs and the City's
share of the Project construction costs,estimated at$354,067,and if applicable,the
difference between the final and initial construction cost estimates.Be responsible for
and pay the difference between the estimated construction cost and Project bid amount
prior to award.After Project completion,be responsible for and pay any outstanding
Project costs,within 30 days of receipt of an invoice.
III. MISCELLANEOUS PROVISIONS

22. Contractor Certifications.The Parties shall certify that all contractors comply with the

REQUEST
The City pursued additional federal funds for roadway and safety improvements on Winchester Road
from 29th Avenue to Southern Avenue in 2023 due to the construction cost increase during design.
BACKGROUND
Maricopa Association of Governments (MAG) attempts to utilize all of the spending authority made
available to the region. To meet this goal, MAG established a closeout process. The most important
criteria for a Closeout project is that it must have completed the federal project development process
through a self-certified agency (ADOT) and be in a position to go to bid by the end of the current federal
fiscal year (June 1 st). Closeout priorities are to advance a current federally funded programmed project
that are ready to be obligated, second is to increase the federal share of projects being obligated, then
street sweepers, and lastly design.

RECOMMENDATION

WHEREAS, on November 16, 2021 the City of Apache Junction
("City") and the State of Arizona Department of Transportation

a pedestrian improvement project on Delaware Drive between 16tn
and Broadway Avenues (the "Project") ; and
WHEREAS, the City recently received, through the Maricopa
Association of Governments ("MAG") , additional federal funds to
cover the increased construction costs since 2021; and

original financial and administrative conditions for

A RESOLUTION OF THE CITY' OF APACHE JUNCTION, ARIZONA
MAYOR AND COMMON COUNCIL, DESIGNATING THE CHIEF FISCAL
OFFICER FOR OFFICIALLY SUBMITTING THE FISCAL YEAR 2025
EXPENDITURE LIMITATION REPORT TO THE ARIZONA AUDITOR
GENERAL
Recitals :
WHEREAS, A.R.S . §41-1279 . 07 (E) requires each county, city, town,
and community college district to annually provide to the
Arizona Auditor General by July 31 the name of the Chief Fiscal
Officer the governing body designated to officially submit the
current year' s annual expenditure limitation report (AELR) on
the governing body' s behalf ; and
WHEREAS, Entities must submit an updated form and documentation
for, any changes in the individuals desigri at.ed to file the AELR.
WHEREAS, the City of Apache Junction Mayor and Council desires
to designate Arigelie Hawley, as the City' s Chief Fiscal Officer.
ENACTMENTS :
NOW THEREFORE BE IT RESOLVED BY THE CITY OF APACHE JUNCTION
MAYOR AND COUNCIL as follows :
SECTION 1 . The recitals above are hereby incorporated as if
fully set forth herein.
SECTION 2 . kngelie Hawley is hereby designated as the City' s
Chief Fiscal Officer for the purposes of submitting the fiscal
year 2025 AELR to the Arizona Auditor General on the governing
body' s behalf .

WHEREAS, the police officers of Apache Junction work devotedly and selflessly
on behalf of the people of this City, regardless of the danger or risk
to themselves; and
WHEREAS, these police officers have safeguarded the lives and property of the
citizens in this great State of Arizona; and
WHEREAS, by the enforcement of our laws, these same police officers have
given our city internal freedom from fear of violence and civil
disorder-, and
WHEREAS, these men and women by it patriotic service and their dedicated
efforts have earned the gratitude of the City of Apache Junction, the
County of Pinal and State of Arizona.

organized and launched by the National Park Trust held
annually on the third Saturday of May; and
WHEREAS,, Kids to Parks Day empowers kids and encourages
families to get outdoors and visit local parks, public
lands, and waters; and
WHEREAS, We should encourage children to lead a more active
lifestyle to combat issues of childhood obesity,diabetes
and hypertension; and

for nature and outdoors; and

BUILDING SAFETY MONTH
MAY 2024
WHEREAS, the City of Apache Junction is committed to recognizing that our
growth and strength depends on the safety and essential role our
homes, buildings and infrastructure play, both in everyday life and
when disasters strike; and
WHEREAS, our confidence in the flexibility of these buildings that.make up our
community is achieved through the commitment of alert guardians,—
building safety and fire prevention officials, architects, engineers,
builders, tradespeople, design professionals, laborers, plumbers and
others in the construction industry—who work year-round to ensure
the safe construction of buildings; and
WHEREAS, these guardians are dedicated members of the International Code
Council, a nonprofit that brings together local, state, territorial, tribal
and federal officials who are experts in the building environment to
create and implement the highest- quality codes to protect us in the
buildings where we live, learn, work and play-, and
WHEREAS, "Mission Possible,," the theme for Building Safety Month 2024,
encourages us all to raise awareness about building safety on a
personal, local and global scale; and
WHEREAS, each year, in observance of Building Safety Month, people all over
the world are asked to consider the commitment to improve building
safety, resilience and economic investment at home and in the
community, and to acknowledge the essential service provided to all
of us by local and state building departments, fire prevention bureaus
and federal agencies in protecting lives and property.
