a project contingency of$50,000. Majority of the work is planned to be
completed within March and April with the last of the generator
equipment installed and connected in October/November. This item
was previously presented at the council meeting on January 21, 2025.

At this time the public has the privilege to address the council with requests, communications, comments
or suggestions relating to city business.All speakers must have already submitted a written "Request to
Speak"form to the city clerk no later than the conclusion of the city manager's report portion of the
agenda. if there is a group speaking on the same item, they should select a spokesperson.All such
remarks shall be addressed to the council as a whole and not to any member thereof. The mayor is
authorized to ask a speaker to stop speaking and leave the podium or to adjourn the meeting if anyone

1. 24-974 Consideration of acceptance of agenda.
2. 24- 75 Consideration of approval of minutes of the regular meeting of January 7,
2025.
3. 24-997 Consideration of award of contract to MR Tanner Construction for the retrofit
of sidewalk ramps along Superstition Boulevard. The work would be through
City of Buckeye Cooperative Contract No. 2025094 in the amount of
$152,517.60 plus a 10% contingency for unforeseen change orders in the
amount of$15,251.76 for a total project cost not to exceed $167,769.36. Work
is planned during the March through May 2025 timeframe.
4. 24-998 Consideration of award of contract to MR Tanner Construction for the
reconstruction of portions of Pinyon, Gregory and Cactus Wren streets within
the Haven Hallow Subdivision west of Delaware Drive. The work would be
through City of Buckeye Cooperative Contract No. 2025094 in the amount of
$439,740.00 plus a 10% contingency for unforeseen change orders in the
amount of$43,974.00 for a total project cost not to exceed $483,714.00. Work
is planned sometime during March through May 2025 time frame.

5. 24-976 Brief summary of intergovernmental updates from mayor and
councilmembers.
Councilmember Heck attended a meeting with Mayors from Chandler, Queen Creek, El Mirage,
and Goodyear. A roundtable discussion was held regarding their city's key priorities and
challenges. He stated it was very encouraging to learn that they were similar to Apache
Junction.
Councilmember Cross, along with several other councilmembers went to the ribbon cutting for
the new Gulf Stream Repair Facility at the Mesa Gateway Airport. He commented on the large
size of the building and informed that they are hiring for many positions including entry level.
Councilmember Soller and many of the councilmembers attended the Grand Opening of the
new Central Arizona College Superstition Mountain Campus expansion. He highlighted some of
the classes they will be offering and the importance of people working in trades.
Mayor Wilson shared that he went to the Dr. Martin Luther King Jr. Award Celebration breakfast
where they presented awards and scholarships. They also played a clip of Dr. King's famous I
have a Dream"speech. Mayor Wilson shared a memory from his childhood.
Mayor Wilson also commented on attending the Gulf Stream Repair Facility and encouraged
everyone to apply for the many jobs they are offering. He highlighted the trade school options
that Central Arizona College is offering.
Mayor Wilson was a judge on the board for the Lost Dutchman Rodeo Queen contest. They
picked new royalty to lead the rodeo next month.

6. 24-977 City Manager's Report.
City Manager Bryant Powell commented on the new additions to Central Arizona College and
how grateful he is for the taxpayers ability to have this investment in the youth of the community.
He also stated that all the training for the new LG facility jobs will be done at the new college
campus.
Mr. Powell shared videos of the new training tool for the Police Department called the Grappler.
The videos showed how it works and helps to keep residents safe.
Mr. Powell announced the upcoming 2025 State of the City on February 12, 2025 at 5:30 p.m. It
will take place at the Desert View Events Center, 2014 S. Starr Road, Apache Junction.
Mr. Powell encouraged everyone to check out the presentation from the Apache Junction Water
Board meeting earlier this evening about water protection.
7. 24- 78 Announcement of Current Events.
Management Analyst Eli Richardson shared upcoming February events:
-24th Annual Lost Dutchman Days Marathon on February 16, 2025. Register at
lostdutchmanmarathon.org for the half marathon, 1 OK, 8K or the 2 mile fun run. The full
marathon is currently sold out.
-61st Annual Lost Dutchman Days Rodeo on February 21 -23, 2025. Tickets can be bought at
the Apache Junction Chamber of Commerce only. Councilmembers discussed why online
ticket sales are not available. City Manager Bryant Powell stated they will speak with the
Chamber of Commerce on this issue.

8. 25-020 Presentation, discussion, public hearing, and consideration of Ordinance
No.1561, a continuation of the 0.2% transaction privilege license tax dedicated
to public right-of-ways.
Vice Mayor Schroeder moved,seconded by Councilmember Nesser that Ordinance No. 1561 be
read by title only and the reading of the entire ordinance be waived.
Motion passed unanimously.
Acting City Clerk McKinney read Ordinance No. 1561 by title only, repealing any conflicting
provisions; and providing for severability.
Councilmember Johnson moved,seconded by Councilmember Nesser that Ordinance No. 1561,
as read by the Acting City Clerk,be approved and adopted.

Assistant City Manager Matt Busby presented the continuation of the .2% sales tax, Ordinance
No. 1561 for roadway maintenance.
Mayor Wilson explained the impact that this sales tax has on the community and how it affords
maintenance of the roads and keeping the residents safe.
Mayor Wilson opened the Public Hearing, receiving no comments from the public, he closed the
public hearing and asked for a motion.
9. 25-022 Presentation, discussion, public hearing, and consideration of Ordinance
No.1562, a continuation of the 0.2% transaction privilege license tax dedicated

for the installation of an emergency backup power generator for City Hall. The
work would be through the Sourcewell Cooperative Contract No. 092222-CAT
in an amount not to exceed $582,500.00 which includes a project contingency
of$50,000.00. Work is planned to start next month and finish during summer
2025.
Public Works Manager Shane Kiesow presented consideration of award of contract to Empire
Power Systems for project PWB23-09C. This project involves the installation of a backup power
generator and needed enclosure for City Hall for an amount not to exceed $582,500.00. This unit
would supply power to all buildings located at the 300 East Superstition Boulevard City Hall
address. Benefits include the mitigation of power disruptions during routine operations, adding
functional capabilities for the buildings during emergency events, and mitigate city's network
vulnerabilities that route through City Hall that impact other city buildings, including Public Works

and Animal Control.
Councilmember concerns included the annual maintenance, refueling time frame, and which
buildings would benefit from the generator.
Mr. Kiesow responded to all concerns.

Mehmood Mohiuddin, 2341 N.Apache Trail,Apache Junction, expressed his frustrations on
billing issues with Republic Services trash service.
Councilmember Cross asked City Staff to look into the billing process with Republic Services.
Donna Carr, 2178 W.Virginia Street, Apache Junction, stated she does not agree with the new
homes being built so close together.

City staff respectfully brings forth Project # PWB23-09C for city council's consideration of award
of contract to Empire Power Systems. This project was discussed with council at the January
21st city council meeting. Project involves the installation of a backup power generator and
needed enclosure for City Hall for an amount not to exceed $582,500.00. This generator would
cover all buildings located at the 300 East Superstition Boulevard City Hall address. Benefits
include the mitigation of power disruptions during routine operations, add functional capabilities
for the buildings during emergency events, and cease disruption to the city's network systems
that route through City Hall that impact other city buildings including Public Works and Animal
Control.
Funding for this project has been made possible by American Rescue Plan Act appropriated to
the city since the COVID-19 outbreak. These monies are allowable to be used on hazard
mitigation infrastructure projects.
Most of the work is planned to take place in March and April 2025 with the final generator
equipment installed and activated in October/November 2025. The work in March and April will
use a portion of the Municipal Court parking lot for the needed construction and equipment yard.
Project staff will work to diminish the impacts of the project to the parking lot, in addition to the
Court and City Hall's operations and the visiting patrons.

FIRST WATER COCKTAIL BAR
An application for a Series 06 Bar Liquor License has been submitted by Justin N. Evans with
First Water Cocktail Bar, located at 1545 E. Broadway Avenue, Apache Junction, AZ, 85120.
The Arizona Department of Liquor Licenses and Control received the application on December
23, 2024, and the Apache Junction City Clerk's Office received the application from them on the
same day. The Notice of Public Hearing was posted at the premises on January 13, 2025,
which allowed for the 20-day Notice as required by state law.
The applicant was notified by first class mail and e-mail of the public hearing date and was
encouraged to attend to address any questions council may have.
Correspondence related to inspections of the premises for safety and code compliant matters
have been received from the Apache Junction Police Department, Building and Safety Division,
Planning and Zoning Department, and the Superstition Fire and Medical District.
All four entities find compliance with the inspection requirements and recommend approval.
Their responses are attached in Legistar for your review.
The city council may now make a recommendation of approval or denial to the Arizona State
Liquor Licenses and Control on this application. This recommendation must take place within
sixty (60) days of the filing of the application, therefore must be done by February 21, 2025.

Evie:
Development Services has no zoning-related objections to a restaurant with a bar re-occupying the former La
Casita Restaurant building at 495 W.Apache Trail. The property is zoned B-1,which allows restaurants and bars
outright.
However,there is some remodeling work which has apparently started at the propertywhich requires the
submittal of a building permit, along with plans drawn by an Arizona registrant. The scope of work includes
plumbing, making the bathrooms ADA compliant, electrical work,tying into the sewer system and other work. The
proprietors were informed of this requirement several weeks ago,they have acknowledged that they need a permit
and plan to hire an architect to get the work done.
In the meantime, a positive recommendation for the liquor license is not an issue. And staff looks forward to
working with the property owners through the permits and inspections process.

SUBJECT: REJECTION OF PROPOSALS FOR RFP#2024-006 FOR THE SALE OR GROUND LEASE
AND DEVELOPMENT OF CITY-OWNED LAND
On November 6, 2024, the city issued a Request for Proposal for the sale or ground lease and
development of city-owned land. On January 9, 2025, the city received two responses: LDG
Development and Old West Welding Service. Staff reviewed the responses and found that both
submissions were unresponsive due to missing documentation.
Recommendation
Staff respectfully request approval to reject all responses for RFP 2024-006.
