A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF
APACHE JUNCTION,ARIZONA,DECLARING THAT A CERTAIN FEDERALLY
PATENTED EASEMENT FOR PUBLIC RIGHTS -OF -WAY PURPOSES
DESCRIBED AS CACTUS WREN STREET FROM WAGONWHEEL ROAD TO
GOLDFIELD ROAD DESCRIBED IN STREET ABANDONMENT CASE
AB -90-01,IS NO LONGER NECESSARY FOR PUBLIC USE AS A ROADWAY
AND IS HEREBY ABANDONED AND EXTINGUISHED AS A PRESENT OR
FUTURE PUBLIC RIGHT-OF-WAY,AND DECLARING AN EMERGENCY.
WHEREAS,the requested abandonment is a Federally Patented
Easement for public right-of-way purposes described as parcels of land
located in Section 22,Township 1 North,Range 8 East,Gila and Salt
River Base and Meridian,Apache Junction,Pinal County,and more par-
ticularly as follows:
Parcel 1 - The North 33'of Cactus Wren Street from Wagonwheel
Road to Goldfield Road.
The Sourth thirty-three feet (33')of the South half of the
Northeast quarter of the Northeast quarter of the Southeast
quarter of the Northeast quarter of Section 22.
EXCEPT the East fifty feet (50')and;
EXCEPT the West thirty-three feet (33')thereof.
Parcel 2 - The South 33'of Cactus Wren Street from Wagonwheel
Road to Goldfield Road.
The North thirty-three feet (33')of the Southeast quarter of the
Northeast quarter of the Southeast quarter of the Northeast
quarter of Section 22.
EXCEPT the East fifty feet (50')and;
EXCEPT the West thirty-three feet (33')thereof.
WHEREAS,the abandonment requested,if approved,would not leave
a parcel in separate ownership without access to an established public
roadway connecting such lands with another public roadway,or have
access by a Federally Patented Easement which may in the future be
developed;and
WHEREAS,the City Council of the City of Apache Junction,
Arizona,finds that said Federally Patented Easement for public right-
of-way purposes as decribed herein,is classified as a local street on
the Apache Junction Street Classifications Plan,and is no longer
necessary for public use as a roadway.
NOW,THEREFORE,BE IT RESOLVED by the Mayor and City Council of
the City of Apache Junction,Arizona,that the above described

Federally Patented Easement reserved for public right-of-way purposes
are hereby extinguished and abandoned as present or future public
right-of-way.
BE IT FURTHER RESOLVED that the abandonment of the public right-
of-way has no effect on reservations for public utility easements.
I t being necessary for the preservation of the peace,health,and
safety of the City of Apache Junction,Arizona,that this resolution
become effective immediately,an emergency is hereby declared to exist
and this resolution shall be effective immediately upon passage and
adoption.

JUNCTION,ARIZONA,THIS 20TH DAY OF MARCH ,1990.
