HomeMy WebLinkAboutRES 90-24RESOLUTION NO.90-24 A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,ARIZONA,FINDING IT NECESSARY TO ACQUIRE A PERMANENT CONSTRUCTION AND DRAINAGE EASEMENT AND A TEMPORARY CONSTRUCTION EASEMENT ON SUPERSTITION BOULEVARD AND ITS INTERSECTION WITH WEEKES WASH,AND DIRECTING THE CITY ATTORNEY IN THE NAME OF THE CITY OF APACHE JUNCTION,ARIZONA,TO CONDEMN PROPERTY NECESSARY AND CONVENIENT TO BE TAKEN FOR THE IMPROVEMENTS,AND DECLARING AN EMERGENCY. WHEREAS,the Mayor and City Council of the City of Apache Junction, Arizona,have previously stated its intent to make certain drainage improvements to Superstition Boulevard at its intersection with Weekes Wash located within the City limits of Apache Junction,Arizona (IGA #JPA-90-65),and WHEREAS,such construction and drainage easements require the acquisition of additional easements. NOW,THEREFORE,BE IT RESOLVED,that the City Attorney is hereby directed to take such actions as are necessary for the condemnation of property described as follows: 1.Permanent Construction and Drainage Easement: A portion of the East half of the Northeast quarter of the Northwest quarter of the Northeast quarter of the Northwest quarter of Section 22. Commencing at the Northwest corner of the East half of the Northeast quarter of the Northwest quarter of the Northeast quarter of the Northwest quarter of Section 22,Township 1 North,Range 8 East,of the Gila and Salt River Base and Meridian,Pinal County,Arizona,Thence South 0 degrees 16 minutes 49 seconds East a distance of 33.00 feet to the True Point of Beginning; Thence North 89 degrees 43 minutes 12 seconds East a distance of 132.00 feet, Thence South 0 degrees 16 minutes 56 seconds East a distance of 7.00 feet, Thence South 89 degrees 43 minutes 12 seconds West a distance of 67.00 feet, Thence South 7 degrees 3 minutes West a distance of 70.58 feet, Thence South 6 degrees 2 minutes 6 seconds West a distance of 191.16 feet, Thence 89 degrees 43 minutes 12 seconds West a distance of 35.00 feet, Thence North 0 degrees 16 minutes 49 seconds West a distance of 267.00 feet back to the Point of Beginning. Commencing at the Northwest corner of the East half of the Northeast quarter of the Northwest quarter of the Northeast quarter of the Northwest quarter of Section 22,Township 1 North,Range 8 East,of the Gila and Salt River Base and Meridian,Pinal County,Arizona,Thence South 0 degrees 16 minutes 49 seconds East a distance of 33.00 feet, Thence North 89 degrees 43 minutes 12 seconds East a distance of 132.00 feet,Thence South 0 degrees 16 minutes 56 seconds East a distance of 7.00 feet,to the True Point of Beginning. Thence South 89 degrees 67.00 feet, Thence South 07 degrees Thence South 06 degrees 146.16 feet, Thence North 17 degrees 149.21 feet, Thence North 32 degrees Point of Beginning. Containing 0.12 acres. 43 minutes 12 seconds West a distance of 03 minutes West a distance of 70.58 feet, 02 minutes 06 seconds West a distance of 38 minutes 06 seconds East a distance of East a distance of 86.67 feet back to the which are necessary for such drainage easements. WHEREAS,it is necessary for the preservation of the peace,health,and safety of the City of Apache Junction,Arizona,an emergency is declared to exist,and this resolution shall be effective immediately upon its passage and adoption. BE IT FURTHER RESOLVED,that the City Attorney commence such action within thirty (30)days of passage of this resolution.
