A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE
JUNCTION,ARIZONA,APPROVING A CONDITIONAL USE PERMIT,CASE NO.
CUP -3-90,FOR A GOLF DRIVING RANGE ON A COMMERCIAL PROPERTY ZONED
C-4 (HEAVY COMMERCIAL).
WHEREAS,said use shall be site specific and shall be located on the
following described property;
All that part of the East half of the Northwest quarter of the
Northeast quarter,and all that part of the Northeast quarter of the
Northeast quarter of Section 28,Township 1 North,Range 8 East,
Gila and Salt River Base and Meridian,Pinal County,Arizona,lying
South of U.S.Highway 60,70,80 and 89.
WHEREAS,satisfactory evidence has been received to indicate that the Golf
Driving Range would be attractive in appearance with surrounding development; and
WHEREAS,i t is understood that the Conditional Use Permit may be revoked
by the City Council upon a finding that there has been material noncompliance
with any condition prescribed in conjunction with the granting of this
Conditional Use Permit;
NOW,THEREFORE,BE IT RESOLVED by the Mayor and City Council of the City
of Apache Junction,Arizona,that a Conditional Use Permit be approved for the
Golf Driving Range described in Case No.CUP -3-90 pursuant to Section 16.0604.3
of the Apache Junction,Arizona Zoning Ordinance,subject to the following
conditions:
1)The applicants are to arrange the overall layout of the site per
plans previously submitted to the Development Services Department.
2)Should this endeavor become a demonstrated hazard,the Zoning
Administrator shall withdraw the Conditional Use Permit.
3)The City shall be an additional insured party for one million
dollars.
4)All lighting installed at the site will be in compliance with the
city's Dark Sky Ordinance.
