HomeMy WebLinkAboutRES 91-23RESOLUTION NO.91-23 A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,DECLARING THAT A CERTAIN FEDERALLY PATENTED EASEMENT FOR PUBLIC ROADWAY AND UTILITY PURPOSES DESCRIBED AS WARREN STREET FROM WICKIUP ROAD TO BOWMAN ROAD DESCRIBED IN ABANDONMENT CASE AB -91-02 IS NO LONGER NECESSARY FOR PUBLIC USE AS A ROADWAY AND IS HEREBY ABANDONED AND EXTINGUISHED AS A PRESENT OR FUTURE PUBLIC RIGHT-OF-WAY. WHEREAS,the requested abandonment is a Federally Patented Easement for public roadway and utility purposes described as a parcel of land located in Section 15,Township 1 North,Range 8 East,Gila and Salt River Base and Meridian,Apache Junction,Pinal County,and more particularly as follows: Parcel 1 - Warren Street (North 1/2 Right -of -Way) The South thirty-three feet (33')of the North half of the Northwest quarter of the Northeast quarter of the Southwest quarter of Section 15, Township 1 North,Range 8 East of the Gila and Salt River Base and Meridian,Pinal County,Arizona. EXCEPT the West thirty-three feet (33')and EXCEPT the East thirty-three feet (33')thereof. Parcel 2 - Warren Street (South 1/2 Right -of -Way) The North thirty-three feet (33')of the South half of the Northwest quarter of the Northeast quarter of the Southwest quarter of Section 15, Township 1 North,Range 8 East of the Gila and Salt River Base and Meridian,Pinal County,Arizona. EXCEPT the West thirty-three feet (33')and EXCEPT the East thirty-three feet (33')thereof. WHEREAS,the abandonment does not leave a parcel in separate ownership without access to an established public roadway connecting such lands with another public roadway,or have access by a Federally Patented Easement which may in the future be developed;and WHEREAS,the City Council of The City of Apache Junction,Arizona,finds that said Federally Patented Easement for public purposes as described herein, is classified as a local street on the Street Classification Plan,and is no longer necessary for public use as a roadway. NOW,THEREFORE,BE IT RESOLVED by the Mayor and City Council of the City of Apache Junction,Arizona,that the above -described Federally Patented Easement reserved for public purposes is hereby extinguished and abandoned as present or future public rights -of -way for roadway purposes. RESOLUTION NO.91-23 PAGE ONE OF TWO BE IT FURTHER RESOLVED that the abandonment of the public right-of-way for roadway purposes has no effect on the reservations for public utility easements;And BE IT FURTHER RESOLVED that the applicant agrees as a stipulation of approval of this abandonment to dedicate to the City right-of-way described as: The North forty feet (40')and the South thirty-three feet (33')and the West thirty-three feet (33')and the East thirty-three feet (33')of the Northwest quarter of the Northeast quarter of the Southwest quarter of Section 15,Township 1 North,Range 8 East of the Gila and Salt River Base and Meridian,Pinal County,Arizona; Together with 20'X 20'triangular cutoffs at the Northwest corner and the Northeast corner and the Southwest corner and the Southeast corner of said Northwest quarter of the Northeast quarter of the Southwest quarter of Section 15. PASSED AND ADOPTED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,ARIZONA,THIS 7th DAY OF June ,1991.
