HomeMy WebLinkAboutRES 92-31RESOLUTION NO.92-31 A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,ARIZONA,APPROVING GENERAL PLAN AMENDMENT GPA-92S-02,A CITY -INITIATED PROPOSAL TO REDESIGNATE ONE AND ONE-HALF ACRES IN SECTION 30 FROM MEDIUM DENSITY RESIDENTIAL/CONVENTIONAL HOMES/- PLANNED AREA DEVELOPMENT TO COMMERCIAL/PLANNED AREA DEVELOPMENT. WHEREAS,the Apache Junction City Council did on June 16,1987,adopt the 1987 Apache Junction General Plan;and WHEREAS,the Apache Junction Planning and Zoning Commission held a public hearing regarding GPA-92S-02 on September 22,1992;and WHEREAS,the Apache Junction Planning and Zoning Commission recommended denial of GPA-92S-02;and WHEREAS,this Council has complied with the requirements for the prepara- tion and adoption of a General Plan amendment pursuant to A.R.S.§ 9-461.05; and WHEREAS,this Council finds that the action taken on this General Plan Amendment is necessary for sound and orderly community development,for preservation of community values,and for the promotion of the general health, safety,convenience,and welfare of the citizens of the Apache Junction community;and WHEREAS,this Council has considered the findings of fact given in Section 0.1.6 of the 1987 Apache Junction General Plan and finds that: 1.The development pattern contained in the Land Use Plan inadequately provides appropriate optional sites for the use proposed in the amend- ment. 2.That the amendment constitutes an overall improvement to the General Plan and is not solely for the good or benefit of a particular landowner or owners at a particular point in time. 3.That the amendment will not adversely impact the community as a whole or a portion of the community by: o Significantly altering acceptable existing land use patterns: o Requiring larger and more expensive improvements to roads,sewer or water systems than are needed to support the prevailing land uses and which,therefore,may impact development of other lands; o Adversely impacting existing uses because of increased traffic on existing systems;or RESOLUTION NO.92-31 PAGE ONE OF TWO O Affecting the livability of the area or the health and safety of the residents. 4.That the amendment is consistent with the overall intent of this General Plan. NOW,THEREFORE,BE IT RESOLVED by the Mayor and City Council of the City of Apache Junction,Arizona,that: GPA-92S-02,a City -initiated General Plan amendment to redesignate a 1.5 -acre site located at the northeast corner of Southern Avenue and the Delaware Drive alignment in Section 30, Township 1 North,Range 8 East,Gila and Salt River Base and Meridian,City of Apache Junction,Pinal County,Arizona,from Medium Density Residential/Conventional Homes/Planned Area Devel- opment to Commercial/Planned Area Development, Be approved and adopted subject to the following stipulations: 1.That any commercial rezoning at this site be provided by planned development. 2.That the final planned development plans for the companion rezoning case PZ-92-11 be approved by the City Council before this site is developed for commercial use.
