A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE
JUNCTION,ARIZONA,AUTHORIZING THE CREATION OF A TWENTY-EIGHT FOOT
(28') WIDE PRIVATE ACCESS EASEMENT, CASE NO.PA -1-92 (IN CONJUNCTION
WITH LAND SPLIT CASE NO.LSM-92-001),FOR A 1.25 -ACRE RESIDENTIAL
PROPERTY ZONED TH AND LOCATED AT 1470 WEST GREASEWOOD STREET.
WHEREAS,a perpetual Private Access Easement described as follows:
The West 28.0 feet of the North 190.19 feet of the South 223.19 feet of
the West half of the Southeast quarter of the Northwest quarter of the
Southwest quarter of the Southwest quarter of Section 17,Township 1
North,Range 8 East,Gila and Salt River Base and Meridian,Apache
Junction,Pinal County,Arizona;AND
A portion of the West half of the Southeast quarter of the Northwest
quarter of the Southwest quarter of the Southwest quarter of Section 17,
Township 1 North,Range 8 East,Gila and Salt River Base and Meridian,
Apache Junction,Pinal County,Arizona,further described as follows:
Commencing at the Southwest corner of the West half of the Southeast
quarter of the Northwest quarter of the Southwest quarter of the Southwest
quarter of Section 17;thence East along the South line of the West half
of the Southeast quarter of the Northwest quarter of the Southwest quarter
of the Southwest quarter of Section 17,a distance of forty-eight feet
(48')to a point;thence North along a line parallel to and forty-eight
feet (48')distant to the West line of the West half of the Southeast
quarter of the Northwest quarter of the Southwest quarter of the Southwest
quarter of Section 17,a distance of thirty-three feet (33')to the TRUE
POINT OF BEGINNING;thence West along a line parallel to and thirty-three
feet (33')distant to the South line of the West half of the Southeast
quarter of the Northwest quarter of the Southwest quarter of the Southwest
quarter of Section 17,a distance of twenty feet (20') to a point;thence
North along a line parallel to and twenty-eight feet (28')distant to the
West line of the West half of the Southeast quarter of the Northwest
quarter of the Southwest quarter of the Southwest quarter of Section 17,
a distance of twenty feet (20')to a point;thence proceeding in a
Southeasterly direction to the TRUE POINT OF BEGINNING;
has been requested in PA -1-92,in conjunction with L.S.M.92-001;and
WHEREAS,said Private Access Easement is for the benefit of providing
ingress and egress for the parcels described as follows:
Parcel "A":The West half of the Southeast quarter of the Northwest
quarter of the Southwest quarter of the Southwest quarter of Section 17,

Township 1 North,Range 8 East,Gila and Salt River Base and Meridian,
Apache Junction,Pinal County,Arizona;Except the North 135 feet thereof
and Reserving the South thirty-three feet (33')thereof for roadways and
utilities;AND
Parcel "B":The North 135 feet of the West half of the Southeast quarter
of the Northwest quarter of the Southwest quarter of the Southwest quarter
of Section 17,Township 1 North,Range 8 East,Gila and Salt River Base
and Meridian,Apache Junction,Pinal County,Arizona;and
WHEREAS,the creation of the Private Access Easement is necessary to
provide access to the new lot created by Land Split Case LSM-92-001;and
WHEREAS, the City of Apache Junction Planning and Zoning Commission did on
May 26,1992,vote to postpone the case with no recommendation to City Council
pending an investigation of possible illegal subdivision activity;and
WHEREAS,said investigation has not led to any conclusive evidence that an
illegal subdivision has been created,other than possible minor illegal Land
Splits which can be handled administratively;and
WHEREAS,satisfactory evidence has been received to indicate that the
requested Private Access Easement does not present a potential hazard to
vehicular and/or pedestrian traffic;and
WHEREAS, the requested Private Access Easement would not be detrimental to
the public health,safety and welfare;
NOW,THEREFORE,BE IT RESOLVED by the Mayor and City Council of the City
of Apache Junction,Arizona,that the Private Access Easement,as described
above,be approved.
BE IT FURTHER RESOLVED that the improvement requirements pursuant to
Section 20.0108 of the Zoning Ordinance are hereby waived.
