A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY
OF APACHE JUNCTION, ARIZONA, ORDERING AND DECLARING
FORMATION OF SUPERSTITION MOUNTAINS COMMUNITY FACILITIES
DISTRICT NO. 1.
WHEREAS, there has been presented to the City Council ("Council") of the City of
Apache Junction, Arizona, a municipal corporation of the State of Arizona
("Municipality") Petitions for Adoption of a Resolution Declaring Formation of
Superstition Mountains Community Facilities District No. 1 ("Petitioners") ,
signed by the owners of all real property described in the Petitions ("Petition-
ers"),
NOW, THEREFORE, BE IT RESOLVED by the Mayor and City Council of the City of
Apache Junction, State of Arizona, as follows:
SECTION I Findings
The Mayor and City Council of the City of Apache Junction, State of Arizona,
hereby finds as follows:
(a) On or prior to this date, there was presented to us, the governing
body ("Council") of the City of Apache Junction, Arizona, an incorporated city
of the State of Arizona ("Municipality"), Petitions for Adoption of a Resolution
Declaring Formation of Superstition Mountains Community Facilities District No.
I ("Petitions"), signed by the owners of all real property described in the
Petitions ("Petitioners") .
(b) The Petitioners pray for the formation of a community facilities
district pursuant to Title 48, Chapter Article 6, Arizona Revised Statutes, as
amended ("Act").
(c) Each Petitioner has attested and declared in the Petitions that on
the date of the Petition, as shown on the assessment roll for State and county
taxes for Pinal County, Arizona, all of the land of such Petitioner to be in the
community facilities district is owned by such Petitioner or, if the person shown
on such assessment roll is no longer the owner of land in the district, that the
name of the successor owner has become known and has been verified by recorded
deed or other similar evidence of transfer of ownership to be a Petitioner.
(d) The Petitioners have attested and declared that all of the land to
be included in the community facilities district shall be benefitted from the
improvements for which the district is proposed to be formed.
(e) The name of the community facilities district for which formation is
prayed is to be Superstition Mountains Community Facilities District No. I
("District").
(f) The District is to be formed, and shall exist, pursuant to the terms
and provisions of the Act.

(g) The District is to initially contain an area of approximately 646
acres of land, but in any event more than 600 acres, wholly within the corporate
boundaries of the Municipality, and is to be composed of the land included in the
parcels described in Exhibit "A", which is attached hereto and is made a part
hereof for all purposes ("Property") .
(h) The District is to be governed by a district board comprised of five
directors appointed by the Council ("District Board") , and none of these persons
is to be a landowner owning more than forty acres in the District, and none is
to be an elected official of the Municipality or an employee or agent of the
landowner or Municipality.
(i) The purpose of the District is to create a sanitary sewer system to
serve the Property and, possibly, additional properties.
(j) A general plan for the District is on file with the Clerk for the
Municipality setting out a general description of the public infrastructure
improvements for which the District is to be formed and the general areas to be
improved ("General Plan") .
(k) The formation of the District may result in the levy of taxes to pay
for the costs of improvements constructed by the District and for their operation
and maintenance.
(1) The Petitioners have prayed, and the Council has determined, that the
public convenience and necessity require the formation of the District.
(m) The Petitions are signed by all owners of all of the land which is
to be in the District, and therefore any requirements of posting, publication,
mailing, notice, hearing and landowner election otherwise required by the Act in
connection with the formation of the District are waived.
(n) There are no residents on the Property, and there are no qualified
electors who reside within the boundaries of the District and no person has
registered to vote within the District within fifty days of this date, and
therefore no election of qualified electors who reside in the District is
required under the Act, and there are also no requirements of posting,
publication, mailing, notice or hearing.
SECTION II Approval of General Plan
The General Plan is hereby approved in all respects.
SECTION III Intention and formation of District
The governing body of the Municipality declares its intention to form the
District. The Petitions are hereby granted and the District is hereby formed
with boundaries as set forth in Exhibit "A", and the District shall have all the
powers and authority established by the Act.

SECTION IV APPOINTMENT OF DIRECTORS
The initial District Board to govern the District is hereby appointed and shall
consist of the following people, each of whom shall serve for the term indicated
next to his or her name below:
a. Tony Vehon Four years
b. John Harambasic Four years
C. Dorma Colvin Six years
d. John Granillo Six years
e. Chris Ochs Six years
No director shall be eligible to receive compensation for his or her services as
a member of the District Board.
SECTION V APPOINTMENT OF CLERK AND TREASURER BY DISTRICT
The District Board shall appoint a District Treasurer and a District Clerk, which
may be the Treasurer and Clerk of the Municipality.
SECTION VI MAP OF THE DISTRICT
A map showing the District boundaries shall be drawn and provided by the District
to the Municipality and to such other persons as may be required by law.
SECTION VII DISSEMINATION OF RESOLUTION
The Municipal Clerk shall cause a copy of this Resolution to be delivered to the
County Assessor and the Board of Supervisors of Pinal County, Arizona, and to the
Department of Revenue of the State of Arizona.
SECTION VIII DISTRICT INDEBTEDNESS
Neither the general fund of the Municipality, nor that of the State of Arizona
or any political subdivision of either (other than the District) shall be liable
for the payment or repayment of any indebtedness of the District; and neither the
credit nor the taxing power of the Municipality, the state of Arizona or any
political subdivision of either (other than the District) shall be pledged
therefor.
