A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,
ARIZONA,DECLARING THAT A CERTAIN PORTION OF DEDICATED RIGHT-OF-WAY
DESCRIBED AS OLD WEST HIGHWAY BETWEEN 21ST AVENUE AND STARR ROAD IS NO
LONGER NECESSARY FOR PUBLIC USE AS A RIGHT-OF-WAY AND IS HEREBY VACATED AS
A PRESENT OR FUTURE PUBLIC RIGHT-OF-WAY AND SHALL BE EXCHANGED FOR OTHER
RIGHT-OF-WAY.
WHEREAS,the vacation is a Dedicated right-of-way for public rights -of -way
purposes described as a parcel of land located in Section 27,Township 1 North,
Range 8 East,Gila and Salt River Base and Meridian,Apache Junction,Pinal
County,and more particularly as follows:
A strip of land within the South half of the Northeast quarter of
the Southwest quarter of the Southeast quarter (S1/2,NE1/4,SW1/4,
SE1/4)of Section 27,Township 1 North,Range 8 East,Gila and Salt
River Base and Meridian,Pinal County,Arizona,more particularly
described as follows:
Commencing at the Northeast corner of said S1/2,NE1/4,SW1/4,
SE1/4;
Thence South along the East line of said S1/2,NE1/4,SW1/4,SE1/4
a distance of 162.02 feet to a point on the North right-of-way line
of Old West Highway (formerly US Highway 60-89);Thence North 540 57'40"West along said North right-of-way a
distance of 60.00 feet to the True Point of Beginning;
Thence continuing North 54° 57'40" West a distance of 222.14 feet to a
point on the north line of said S1/2,NE1/4,SW1/4,SE1/4;
Thence South 35° 02'20"West a distance of 25.00 feet;
Thence South 54° 57'40"East a distance of 222.14 feet;
Thence North 35° 02'20"East a distance of 25.00 feet back to the Point
of Beginning.
WHEREAS,the vacation,if approved,would not leave a parcel in separate
ownership without access to an established public roadway connecting such lands
with another public roadway,or have access by a Federally Patented Easement
which may in the future be developed;and
WHEREAS, the vacation of right-of-way is intended to abolish public roadway
purposes only, and is hereby retained for public utility purposes as an easement.
NOW,THEREFORE,BE IT RESOLVED by the Mayor and City Council of the City
of Apache Junction,Arizona,that the above -described Dedication reserved for
public right-of-way purposes is hereby extinguished and vacated as present or
future public rights -of -way,and is retained for public utility purposes as an
easement.
