HomeMy WebLinkAboutRES 93-20RESOLUTION NO.93-20 A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,APPROVING GENERAL PLAN AMENDMENT GPA-93-03,A CITY -INITIATED PROPOSAL TO REDESIGNATE A SEVEN -ACRE AREA IN SUPERSTITION VILLA SUBDIVISION NORTHWEST OF IDAHO ROAD AND SOUTHERN AVENUE FROM COMMERCIAL TO INDUSTRIAL/PLANNED AREA DEVELOPMENT. WHEREAS,the Apache Junction City Council did,on June 16,1987,adopt the 1987 Apache Junction General Plan;and WHEREAS,the Apache Junction Planning and Zoning Commission held a public hearing regarding GPA-93-03 on October 12,1993;and WHEREAS,the Apache Junction Planning and Zoning Commission recommended denial of GPA-93-03 by a vote of 4 to 3;and WHEREAS,this Council has complied with the requirements for the preparation and adoption of a General Plan amendment pursuant to A.R.S.Section 9-461.05;and WHEREAS,this Council finds that the action taken on this General Plan Amendment is necessary for sound and orderly community development,for preservation of community values and for the promotion of the general health, safety,convenience,and welfare of the citizens of the Apache Junction community;and WHEREAS,this Council makes the following Findings of Fact required by Section 0.1.6 of the 1987 Apache Junction General Plan to support the approval of GPA-93-03: 1.The development pattern contained the Land Use Plan inadequately provides appropriate optional sites for the use proposed in the amendment. 2.That the amendment constitutes an overall improvement to the General Plan and is not solely for the good or benefit of a particular landowner or owners at a particular point in time. 3.That the amendment will not adversely impact the community as a whole or a portion of the community by: *Significantly altering acceptable existing land use patterns; RESOLUTION NO.93-20 PAGE ONE OF TWO •Requiring larger and more expensive improvements to roads,sewer or water systems than are needed to support the prevailing land uses and which,therefore,may impact development of other land; •Adversely impacting existing uses because of increased traffic on existing systems;or •Affecting the livability of the area or the health and safety of the residents. 4.That the amendment is consistent with the overall intent of this General Plan. NOW,THEREFORE,BE IT RESOLVED by the Mayor and City Council of the City of Apache Junction,Arizona,that: GPA-93-03,a City -initiated general plan amendment to redesignate from Commercial to Industrial/Planned Area Development the following legally -described parcels: Lots 326 through 371 and Lots 380 through 395 of Superstition Villa Subdivision,in Section 29, Township I North,Range 8 East,Gila and Salt River Base and Meridian,Apache Junction,Pinal County, Arizona. Be approved and adopted;provided that: I.Any industrial rezoning at this site be processed by planned development. 2.Appropriate measures be required to mitigate land -use conflicts. PASSED AND ADOPTED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,THIS 2ND DAY OF NOVEMBER ,1993.
