A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,
ARIZONA,DECLARING THAT A CERTAIN FEDERALLY PATENTED EASEMENT FOR PUBLIC
RIGHT-OF-WAY PURPOSES DESCRIBED AS ROOSEVELT STREET DESCRIBED IN
ABANDONMENT CASE AB-92-02 IS NO LONGER NECESSARY FOR PUBLIC USE AS A
ROADWAY AND IS HEREBY ABANDONED AND EXTINGUISHED AS A PRESENT OR FUTURE
PUBLIC RIGHT-OF-WAY.
WHEREAS,the requested abandonment is a Federally Patented Easement for
public rights -of -way purposes described as a parcel of land located in
Section 22,Township 1 North,Range 8 East,Gila and Salt River Base and
Meridian,Apache Junction,Pinal County,and more particularly as follows:
Parcel 1 -The south thirty-three feet (33')of the South half of the
Southeast quarter of the Northeast quarter of the Southeast quarter of the
Northwest quarter of Section 22,Township 1 North,Range 8 East of the
Gila and Salt River Base and Meridian,Pinal County Arizona.
EXCEPT the West 33'and the East 40'thereof.
Parcel 2 -The north thirty-three feet (33')of the North half of the
Northeast quarter of the Southeast quarter of the Southeast quarter of the
Northwest quarter of Section 22,Township 1 North,Range 8 East of the
Gila and Salt River Base and Meridian,Pinal County,Arizona.
EXCEPT the West 33'and the East 40'thereof.
WHEREAS,the abandonment requested,if approved,would not leave a parcel
in separate ownership without access to an established public roadway
connecting such lands with another public roadway,or have access by a
Federally Patented Easement which may in the future be developed;and
WHEREAS,the City Council of The City of Apache Junction,Arizona,finds
that said Federally Patented Easement for public rights -of -way purposes as
described herein,is classified as a local street on the Street Classification
Plans,and is no longer necessary for public use as a roadway.
NOW,THEREFORE,BE IT RESOLVED by the Mayor and City Council of the City
of Apache Junction,Arizona,that the above -described Federally Patented
Easement reserved for public right-of-way purposes is hereby extinguished and
abandoned as present or future public rights -of -way.Said Federally Patented
Easement is being abandoned to the benefit of the adjoining parcels of land
described as:parcel #103-03-056E and 103-03-056F per the Pinal County
Assessor's Map,pursuant to the applicable provisions of Arizona law.
BE IT FURTHER RESOLVED that the abandonment of the public right-of-way has
no effect on the reservations for public utility easements.
