A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY
OF APACHE JUNCTION,ARIZONA,REPEALING RESOLUTION NO.
93-03 AND REMOVING THE QUESTION CONCERNING AUTHORITY FOR
THE CITY OF APACHE JUNCTION TO CONSTRUCT,PURCHASE,
ACQUIRE OR LEASE ANY PLANT OR PROPERTY OR PORTION THERE-
OF DEVOTED TO THE BUSINESS OF OR SERVICES RENDERED BY A
WATER SYSTEM TO ENABLE THE CITY TO ENGAGE IN THE BUSI-
NESS OF OWNING OR OPERATING A WATER SYSTEM FROM THE
BALLOT FOR THE ELECTION OF THE CITY OF APACHE JUNCTION
OF MAY 18,1993;AND DECLARING AN EMERGENCY.
WHEREAS,Resolution No.93-03 as adopted by the City Council on the 16th day of
February,1993,called for the addition of a question to the municipal election
of the City of Apache Junction on May 18,1993 seeking authorization for the City
of Apache Junction to construct, purchase, acquire or lease any plant or property
or portion thereof devoted to the business thereof or services rendered by a
water system to enable the City of Apache Junction to engage in the business of
owing or operating a water system;and
WHEREAS,it is the desire of the Mayor and City Council of the City of Apache
Junction to remove said question from the May 18,1993 general election ballot
of the City of Apache Junction;
BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,
STATE OF ARIZONA,AS FOLLOWS:
SECTION I
The Mayor and City Council of the City of Apache Junction hereby repeal Resolu-
tion No.93-03 as adopted on the 16th day of February,1993 in its entirety.
SECTION I I
The question of whether the City of Apache Junction shall be authorized to
undertake the purchase,acquisition,construction and/or lease of any plant,
property or portion thereof devoted to the business of a water system described
in Section I of Resolution No.93-03 as adopted by the Mayor and City Council of
the City of Apache Junction on the 16th day of February,1993 is ordered to be
removed from the ballot for the election to be held on the 18th day of May,1993.
SECTION III
Whereas,the immediate operation of the provisions of this resolution is neces-
sary for the preservation of the public peace,health and safety,an emergency
is declared to exist,and this resolution shall be in full force and effect
immediately upon passage and adoption,and it is so enacted.
