HomeMy WebLinkAboutRES 94-29RESOLUTION NO.94-29 A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,DECLARING THAT CERTAIN FEDERALLY PATENTED EASEMENTS FOR PUBLIC RIGHT-OF-WAY PURPOSES DESCRIBED AS CACTUS WREN STREET BETWEEN BOWMAN ROAD AND ACACIA ROAD,AND STAGECOACH ROAD BETWEEN SCENIC STREET AND ROOSEVELT STREET DESCRIBED IN ABANDONMENT CASE AB -94-01,ARE NO LONGER NECESSARY FOR PUBLIC USE AS ROADWAYS AND ARE HEREBY ABANDONED AND EXTINGUISHED AS PRESENT OR FUTURE PUBLIC RIGHTS -OF -WAY. ,WHEREAS,the requested abandonments are Federally Patented Easements for public right-of-way purposes described as parcels of land located in Section 22, Township 1 North,Range 8 East,Gila and Salt River Base and Meridian,Apache Junction,Pinal County,and more particularly as follows: Adjacent to 103-02-046 The West thirty-three feet (33')and the North thirty-three feet (33')of the Southeast quarter of the Northwest quarter of the Southwest quarter of the Northeast quarter of Section 22,Township 1 North,Range 8 East of the Gila and Salt River Base and Meridian,Pinal County,Arizona. EXCEPT THE SOUTH THIRTY-THREE FEET (33')AND EXCEPT THE EAST THIRTY-THREE FEET (33')THEREOF. Adjacent to 103-02-041 The South thirty-three feet (33')and the West thirty-three feet (33')of the South half of the Northeast quarter of the Northwest quarter of the Southwest quarter of the Northeast quarter of Section 22, Township 1 North, Range East of the Gila and Salt River Base and Meridian,Pinal County, Arizona. EXCEPT THE WEST AND THE EAST THIRTY-THREE FEET (33')THEREOF. WHEREAS, the abandonments requested, if approved, would not leave a parcel in separate ownership without access to an established public roadway connecting such lands with another public roadway,or have access by a Federally Patented Easement which may in the future be developed;and WHEREAS,the City Council of The City of Apache Junction,Arizona,finds that said Federally Patented Easements for public rights -of -way purposes as described herein,are classified as local streets on the Street Classification Plans,and are no longer necessary for public use as roadways. NOW,THEREFORE,BE IT RESOLVED by the Mayor and City Council of the City of Apache Junction, Arizona, that the above -described Federally Patented Easements are hereby extinguished and abandoned as present or future public rights -of -way. BE IT FURTHERRESOLVEDthatthe abandonmentofthe publicright-of-wayhas no effect on the reservations for public utility easements.
