HomeMy WebLinkAboutRES 94-34RESOLUTION NO.94-34 A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,APPROVING GENERAL PLAN AMENDMENT CASE GPA-94-01,A CITY COUNCIL- INITIATED MAJOR UPDATE TO THE 1987 GENERAL PLAN, AMENDING AND UPDATING THE 'LAND USE PLAN',AND AMENDING AND STREAMLINING THE PLAN'S 'GOALS AND OBJECTIVES' SECTION. WHEREAS,the Apache Junction City Council did on June 16,1987,adopt the 1987 Apache Junction General Plan;and WHEREAS,this is the first major update to the 1987 General Plan;and WHEREAS,the City Council did on April 6,1993,appoint a citizen's committee called the General Plan Update Task Force for the primary purpose of obtaining detailed citizen input concerning their desires and vision for the community;and to subsequently take this input and formulate it into recommendations for updating the General Plan;and WHEREAS,it is recognized that several amendments to the General Plan have been proposed since its adoption in 1987,some of which were approved;and WHEREAS,the General Plan Update Task Force has proposed various recommendations for amending the Plan's 'Land Use Plan'and 'Goals and Objectives'section.Proposed changes to the 'Land Use Plan'consist of:1)a graphical update to the Plan showing previously approved General Plan Amendments since the last graphical update in June of 1989;and 2)various newly proposed land use changes,reflecting recommendations and input received through a community -wide survey and a series of public participation meetings.Proposed changes to the 'Goals and Objectives'section are being recommended for the purpose of:1)deleting many of the redundant clauses,thus making this section more streamlined, clearer and easier to understand; and 2) reflecting many of the comments and suggestions made by the citizenry via the survey and the public participation meetings;and WHEREAS,the Apache Junction Planning and Zoning Commission held public hearings regarding GPA-94-01 on November 8,22 and 29,1994;and WHEREAS,the Apache Junction Planning and Zoning Commission recommended approval of GPA-94-01;and WHEREAS, the subject areas considered for land use redesignation,as shown on the map titled "Changes to Land Use Plan"and made a part hereof,are as follows: RESOLUTION NO.94-34 PAGE ONE OF TWELVE SUBSECTION A:THE 'LAND USE PLAN'IS TO BE AMENDED AS FOLLOWS: 1)redesignating approximately 110 acres on the north side of W.Lost Dutchman Blvd.,between N.Meridian Dr.and N.Ironwood Dr.,from 'Medium Density Residential/Manufactured Homes Permitted'to 'Low Density Residential for Conventional Homes'; 2)redesignating approximately 40 acres at the southwest corner of E.Lost Dutchman Blvd.and N.Tomahawk Rd.from 'Public/Semi-Public Space'to 'Park/Open Space'; 3)redesignating approximately 15 acres at the southeast corner of E.Lost Dutchman Blvd.and N.Tomahawk Rd.from 'Low Density Residential by Planned Area Development'to 'Commercial'; 4)redesignating approximately 60 acres along both sides of N.Meridian Dr., between W.Superstition Blvd.and W.Apache Trail,from 'Medium Density Residential for Conventional Homes'to 'Medium Density Residential/Manufactured Homes Permitted'; 5)redesignating approximately 10 acres just west of the northwest corner of W.Broadway Ave.and S.Ironwood Dr.from 'Commercial'to 'Public/Semi- Public Space'; 6)redesignating approximately 2.5 acres at the northwest corner of S.San Marcos Dr.and W.Broadway Ave.from 'Commercial'to 'Medium Density Residential for Conventional Homes'; 7)redesignating approximately 20 acres at the southeast corner of E. Tomahawk Rd.and E.36th Ave.from 'Park/Open Space'to 'Medium Density Residential/Manufactured Homes Permitted'; 18)newly designating a previously undesignated area approximately 140 acres in size at the northeast corner of US60 and S.Goldfield Rd.to 'Commercial'; 19)newly designating a previously undesignated area approximately 60 acres in size along the north side of US60 and east of S.Arroyo Rd.to 'Park/Open Space';and WHEREAS,the provisions of the Plan's 'Goals and Objectives'section considered for changes,additions or deletions are as follows: SUBSECTION B:THE FOLLOWING PROVISIONS OF THE 'GOALS AND OBJECTIVES' SECTION ARE TO BE CHANGED (OR RENUMBERED)TO READ AS FOLLOWS: Objective A-1:Allow urban growth only in a planned,orderly manner to encourage high quality development. Former Policy A -lb is now Policy A -la. Former Policy A -lc is now Policy A -lb. Objective A-2:Actively promote the development of land within the City which is already served by public facilities and utilities. Policy A -2a:The City shall encourage infill development. RESOLUTION NO.94-34 PAGE THREE OF TWELVE Policy B -lc: Former Policy Former Policy Former Policy Policy B -4b: Policy 6-4c: Objective C-1: Policy C -lb: The City shall establish on an annual basis a Capital Improvement Program (CIP)which identifies and ranks improvement districts,including public neighborhood improvement projects (such as for the provision of curbs and sidewalks),estimates costs,establishes timing,and identifies revenue sources to carry out the projects. B -le is now Policy 6-1d. 6-3b is now Policy B -3a. B -3c is now Policy 6-3b. The City shall establish and enforce commercial and industrial district design standards,including residential buffering requirements,to encourage the development of new quality business environments. The City shall encourage the development of nodal commercial center areas and service business oriented,P.A.D.-controlled "strip"commercial development. Develop standardized design themes for commercial and industrial areas. The City shall develop a streetscape image system wherein the hierarchy of streets (i.e.,section line roads,mid -section line roads,etc.)would determine different levels of aesthetic improvement requirements. Objective E-3:Promote the preservation of the natural desert environment in and around Apache Junction. Former Goal I is now Goal H. Former Objective I-1 is now Objective H-1. Former Objective 1-2 is now Objective H-2. Former Policy I -2/3a is now Policy H -2a. Former Goal J is now Goal I. Former Objective J-1 is now Objective I-1. Former Policy J -lb is now Policy I -la. Former Goal K is now Goal J. Former Objective K-1 is now Objective J-1. RESOLUTION NO.94-34 PAGE FOUR OF TWELVE Former Objective K-2 is now Objective J-2. Former Goal L is now Goal K. Former Objective L-1 is now Objective K-1. Former Policies L -la through L-lf are now Policies K -la through K -if Former Goal M is now Goal L. Former Objective M-1 is now Objective L-1 and reads: Objective L-1:Encourage pedestrian,bicycle circulation and horse trails (where appropriate) within neighborhoods,and to and from commercial areas throughout the City of Apache Junction. Former Policy M -la is now Policy L -la and reads: Policy L -la:The City shall encourage the preparation of a plan for the improvement of the overall sidewalk system, including the installation of handicapped access ramps at key intersections,and to recreation trails throughout the City. Former Policy M -lb is now Policy 1 -lb. Former Policy M -lc is now Policy L -1c. Former Goal 0 is now Goal M. Former Objective 0-1 is now Objective M-1. Former Policies 0 -la through 0-1f are now Policies M -la through M -if. Former Goal P is now Goal N. Former Objective P-1 is now Objective N-1. Former Objective P-2 is now Objective N-2. SUBSECTION C:THE FOLLOWING PROVISIONS ARE TO BE ADDED TO THE 'GOALS AND OBJECTIVES'SECTION: Policy 6-4d:The City shall encourage the development of the industrial areas. Objective F-1: RESOLUTION NO.94-34 PAGE FIVE OF TWELVE Encourage development of all types of housing through expeditious and proper application of land use planning, zoning regulations,site design review and building inspections to enhance the quality of life in Apache Junction. Policy E -lb: Policy E -lc: Policy E -2c: Policy E -3a: RESOLUTION NO.94-34 PAGE SIX OF TWELVE Objective G-1:Work to develop a broad -based neighborhood revitalization program which maximizes the use of all local,state and federal resources to achieve housing rehabilitation,new housing development and the provision of affordable rental housing and the overall revitalization of older neighborhoods in Apache Junction. Policy K-lg:The City shall encourage the development of transit programs. SUBSECTION D:THE FOLLOWING PROVISIONS OF THE 'GOALS AND OBJECTIVES'SECTION ARE TO BE DELETED: Policy A -la:The City shall prepare and adopt a Comprehensive Land Use Plan to identify its objectives with regard to land use and development within the City,and on the urban fringe,through the year 2005. Policy B -id:The City shall provide a diverse mix of retirement and family residential neighborhoods consistent with the Land Use Plan. Policy 6-3a:The City shall prohibit the expansion of non -conforming uses currently allowed under the existing zoning ordinance. Policy 6-4d:The City shall encourage the development of "mixed use" projects incorporating innovative mixing of residential, commercial and industrial uses. Policy C -1d:The City shall encourage architectural forms and images that provide continuity for building complexes and are climate responsive. Policy E -la:The City shall utilize transportation system management (TSM) techniques, such as synchronized traffic lighting, and efficient traffic flow and turning movements to minimize automobile generated air pollution. The City shall encourage land use developments that minimize vehicle trips and trip lengths. The City shall encourage the paving of dirt roads to reduce fugitive urban dust. The City shall develop a City-wide plan for reclaiming and recycling stormwater and wastewater. The City shall minimize natural and man-made environmental hazards. Policy E -3b: Policy E -3c: Policy E -3d: Policy E -3e: Objective F-1: The City shall route all hazardous wastes away from residential neighborhoods. The City shall limit residential development from areas of 60 LDN noise levels or greater (e.g.truck routes, airports,highways). The City shall restrict residential development from known subsidence areas. The City shall require all disturbed land be revegetated to protect nearby areas from erosion. Encourage new housing developments that offer a range of new housing types and sizes in the Apache Junction market. Objective F-2:Utilize Building Codes and Zoning and Subdivision Regulations to assure quality housing development in Apache Junction. Objective F-3:Promote the development and/or rehabilitation of affordable rental housing compatible in scale and character with their surrounding neighborhoods. Policy F -1/2/3a:The City shall acknowledge that the provision of new housing is primarily the job of the private sector.In responding to market demands,the City shall encourage development of all types of housing through expeditious and proper application of land use planning,zoning regulations, site design review and building inspections to enhance the quality of life in Apache Junction. Policy F -1/2/3b:The City shall continue to utilize all available local, state and federal resources to help provide decent, safe housing for persons of all income levels. Policy F -1/2/3c:The City shall require that mobile home and recreational vehicle parks be developed in areas adequately served by public infrastructure and services. Objective G-1: Policy G -la: RESOLUTION NO.94-34 PAGE SEVEN OF TWELVE Work to remove all dilapidated,vacant and abandoned structures in the City unless they have mitigating historical or architectural significance. The City shall develop a broad -based neighborhood revitalization program which maximizes the use of all local,State and Federal resources to achieve housing rehabilitation,new housing development and the provision of affordable rental housing and the overall revitalization of older neighborhoods in Apache Junction. Policy G -lb:The City shall provide necessary public facilities and services as part of overall neighborhood revitalization efforts to complement publicly assisted housing rehabilitation and to promote private housing rehabilitation. Objective G-2:Encourage the preservation and restoration of appropriate historically and architecturally significant structures. Policy G -2a:The City shall support and work with the Arizona Historic Preservation Office and property owners to pursue National Register historic designation of appropriate structures within Apache Junction and work to preserve and revitalize these areas on an overall basis in order to retain and respect Apache Junction's heritage. GOAL H:IMPROVE THE SELECTION AND EXPAND THE QUANTITY AND QUALITY OF HOUSING UNITS IN APACHE JUNCTION. Objective H-1:Encourage the expansion of housing unit production in Apache Junction. Objective H-2: Objective H-3: Policy H -1/2/3a: Encourage the development of a wide selection of single- family housing types and sizes in Apache Junction. Encourage the development of planned residential neighborhoods in newly developing areas of Apache Junction. The City shall carefully follow an adopted Land Use Plan as part of its General Plan to encourage quality housing development,by designating large residential areas buffered from adjacent uses,and providing a full range of supportive uses (e.g.retail,schools,services, etc). Policy H -1/2/3b:The City shall establish and utilize an annual Capital Improvements Program to provide public facilities and utilities to new residential areas on an orderly basis. Policy H -1/2/3c:The City shall aggressively market itself to the Phoenix Metropolitan Area and regional housing developers as a good place to develop with its expanding employment base,interest in quality planning and development,and willingness to work with the developer to insure an expeditious review,approval and development process. RESOLUTION NO.94-34 PAGE EIGHT OF TWELVE Policy I -la: Policy I -lb: Policy I -lc: Policy I -id: Policy 1 -le: Policy I -if: Policy I -1g: Objective 1-3: Policy J -la: Policy K -1/2a: RESOLUTION NO. 94-34 PAGE NINE OF TWELVE The City shall carefully follow its adopted Land Use Plan to encourage full,quality development,and/or redevelopment,as appropriate,of its neighborhoods. The City shall refine its Zoning Ordinance and Official Zoning Map,as necessary,and utilize them,in conjunction with its subdivision regulations, floodplain management regulations and capital improvement expenditures,to implement the Land Use Plan and insure neighborhood quality. The City shall establish on an annual basis a Capital Improvement Program (CIP)which identifies and ranks public neighborhood improvement projects,estimates costs,establishes timing,and identifies revenue sources to carry out the projects. The City shall provide a diverse mix of retirement and family residential neighborhoods consistent with the Land Use Plan. The City shall carefully follow an adopted Land Use Plan as part of its General Plan to encourage quality housing development,by designating large residential areas buffered from adjacent uses,and providing a full range of supportive uses (e.g.retail,schools,services, etc.). The City shall establish and utilize an annual Capital Improvements Program to provide public facilities and utilities to new residential areas on an orderly basis. The City shall aggressively market itself to the Phoenix Metropolitan Area and regional housing developers as a good place to develop with its expanding employment base,interest in quality planning and development,and willingness to work with the developer to insure an expeditious review,approval and development process. Expand community support services and facilities to serve an expanding population base in Apache Junction. The City shall establish and adopt a Land Use Plan,as a component of its General Plan,that includes the designation of appropriately scaled commercial centers located to serve anticipated residential growth. The City shall carefully follow its adopted Land Use Plan,Zoning Ordinance,Subdivision Regulations and public facilities plans to guide proper land development in non-residential areas. Policy K -1/2b:The City shall establish and enforce commercial and industrial district design standards to encourage the development of new quality business environments. Policy K -1/2c:The City shall encourage the development of nodal commercial center areas and discourage "strip" commercial development. Policy K -1/2d:The City shall encourage the development of "mixed -use" projects incorporating innovative mixing of residential, commercial and industrial uses. Objective K-3:Recruit and encourage development of more industries requiring skilled labor. Policy K -3a:The City shall continue to aggressively market itself to research and development,industrial assembly and high tech manufacturing firms,as well as to target additional industrial categories that desire the assets of Apache Junction. Policy K -3b:The City shall work closely with both industrial and residential developers to coordinate information flow to each regarding the advantages of an Apache Junction location,and that every effort will be made to accommodate high quality, compatible development of each type. GOAL N:PROVIDE A SYSTEM OF COMMUNITY FACILITIES AND HUMAN SERVICES WHICH ARE ADEQUATE IN TERMS OF SERVICES OFFERED,LOCATION AND SIZE, AT THE LOWEST POSSIBLE COSTS FOR DEVELOPMENT,OPERATION AND MAINTENANCE. Objective N-1:Develop an adequate,efficient,and economic sanitary sewer system. Policy N -la:The City shall actively seek to utilize all local, regional,state and federal resources to develop a sanitary sewer system,including necessary trunk and lateral sewer lines and sewage treatment facility. Policy N -lb:Where feasible,the City shall require that all residential, commercial and industrial structures within the City limits be connected to the municipal sanitary sewer system. Objective N-2:Maintain a safe and plentiful water supply system. Policy N -2a: RESOLUTION NO.94-34 PAGE TEN OF TWELVE The City shall ensure that an adequate supply of potable water is treated and delivered to all municipal users in compliance with state and federal standards. Policy N -2b:The City shall require that all waterlines are sized to ensure adequate water pressure and fire flows. Policy N -2c:The City shall encourage water conservation measures consistent with State Department of Water Resources Management Plans. Policy P -la:The City shall encourage the cooperation of County and State law enforcement agencies with the City of Apache Junction to provide an effective law enforcement network. Policy P -lb:The City shall continually update nuisance ordinances to promote effective law enforcement. Policy P -2a:The City shall work closely with the Fire District to maintain an adequate supply of necessary fire equipment and personnel to protect the City in a timely,safe and effective manner. Policy P -2b:The City shall continually update zoning regulations and building codes to meet accepted fire insurance requirements. Policy P -2c:Prior to development approval or annexation the City shall ensure that adequate on -site water supply and pressure is available for fire protection;and WHEREAS,this Council has complied with the requirements for the preparation and adoption of a General Plan amendment pursuant to A.R.S.§9- 461.05;and WHEREAS,this Council finds that the action taken on this General Plan Amendment is necessary for sound and orderly community development,for preservation of community values,and for the promotion of the general health, safety, convenience and welfare of the citizens of the Apache Junction community; and WHEREAS,this Council has considered the findings of fact given in Section D.1.6 of the 1987 Apache Junction General Plan and finds: 1.That the amendment constitutes an overall improvement to the General Plan and is not solely for the good or benefit of a particular landowner or owners at a particular point in time. 2.That the amendment will not adversely impact the community as a whole or a portion of the community by: .Significantly altering acceptable existing land use patterns; RESOLUTION NO.94-34 PAGE ELEVEN OF TWELVE Requiring larger and more expensive improvements to roads,sewer or water systems than are needed to support the prevailing land uses and which,therefore,may impact development of other lands; .Adversely impacting existing uses because of increased traffic on existing systems;or .Affecting the livability of the area or the health and safety of the residents. 3.That the amendment is consistent with the overall intent of this General Plan. 4.That the amendment is necessary to rationalize land use policy with existing development and existing parcelization. NOW,THEREFORE,BE IT RESOLVED by the Mayor and City Council of the City of Apache Junction,Arizona,that case GPA-94-01,a General Plan amendment proposing a major update to the 1987 General Plan's 'Land Use Plan'and 'Goals and Objectives'section,be approved and adopted.
