HomeMy WebLinkAboutRES 95-18RESOLUTION NO.95-18 A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,DECLARING THAT A CERTAIN FEDERALLY PATENTED EASEMENT FOR PUBLIC ROADWAY PURPOSES DESCRIBED AS SHIPROCK STREET BETWEEN CORTEZ ROAD AND ACACIA ROAD AS DESCRIBED IN ABANDONMENT CASE AB -95-01,IS NO LONGER NECESSARY FOR PUBLIC USE AS A ROADWAY AND IS HEREBY ABANDONED AND EXTINGUISHED AS A PRESENT OR FUTURE PUBLIC RIGHT-OF-WAY. WHEREAS, the requested abandonment is a Federally Patented Easement for public rights -of -way purposes described as a strip of land located in Section 15, Township 1 North,Range 8 East,Gila and Salt River Base and Meridian,Apache Junction,Pinal County,and more particularly as follows: Part 1 -(adjacent to parcel #100-27-015E) The South thirty-three feet (33') of the South half of the West half of the South half of the Northwest quarter of the Northwest quarter of the Southeast quarter of Section 15, Township 1 North, Range 8 East of the Gila and Salt River Base and Meridian,Pinal County,Arizona, EXCEPT THE WEST FORTY FEET THEREOF. Part 2 -(adjacent to parcel # 100-27-015F) The South thirty-three feet (33') of the South half of the East half of the South half of the Northwest quarter of the Northwest quarter of the Southeast quarter of Section 15, Township 1 North, Range 8 East of the Gila and Salt River Base and Meridian,Pinal County,Arizona, EXCEPT THE EAST THIRTY-THREE FEET THEREOF. Part 3 -(adjacent to parcel # 100-27-016C) The North thirty-three feet (33')of the following described parcel:Beginning at the Northwest quarter corner of the Southwest quarter of the Northwest quarter of the Southeast quarter of Section 15,Township 1 North Range 8,Gila and Salt River Base and Meridian,Pinal County,Arizona;Thence East 510',Thence South 330',thence West 221',Thence North 188.41',thence West 289',Thence North 141.59'back to the Point of Beginning. EXCEPT THE WEST FORTY FEET THEREOF. Part 4 -(adjacent to parcel #100-27-016B) The North thirty-three feet (33')of the East 150'of the North half of the Southwest quarter of the Northwest quarter of the Southeast quarter of Section 15 Township 1 North,Range 8 East of the Gila and Salt River Base and Meridian, Pinal County,Arizona, EXCEPT THE EAST THIRTY-THREE FEET THEREOF. RESOLUTION NO.95-18 PAGE ONE OF TWO WHEREAS, the abandonment requested, if approved, would not leave a parcel in separate ownership without access to an established public roadway connecting such lands with another public roadway,or have access by a Federally Patented Easement which may in the future be developed;and WHEREAS, the City Council of The City of Apache Junction, Arizona, finds that said Federally Patented Easement for public rights -of -way purposes as described herein,is classified as a local street on the Street Classification Plan,and is no longer necessary for public use as a roadway. NOW, THEREFORE, BE IT RESOLVED by the Mayor and City Council of the City of Apache Junction,Arizona,that the above -described Federally Patented Easement reserved for public right-of-way purposes is hereby extinguished and abandoned as present or future public rights -of -way. BE IT FURTHER RESOLVED that the abandonment of the public right-of-way has no effect on the reservations for public utility easements.
