A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY
OF APACHE JUNCTION,ARIZONA,GRANTING PERMISSION AND
GIVING CONSENT TO THE WATER UTILITIES COMMUNITY
FACILITIES DISTRICT (CITY OF APACHE JUNCTION,ARIZONA)
TO ENTER INTO AGREEMENTS WITH PERSONS OUTSIDE THE
DISTRICT TO PROVIDE THE SERVICES TO SUCH PERSONS AND
PROPERTY:AND DECLARING AN EMERGENCY.
WHEREAS,the City of Apache Junction,Arizona has duly and properly
formed the Water Utilities Community Facilities District (City of
Apache Junction,Arizona)for the purpose of providing water
service:and
WHEREAS,A.R.S.§48-709(A)(14)provides that i t is only with the
consent of the governing body of the municipality which formed the
district that a district may enter into agreements with persons
outside the district to provide service to such persons and
property:
NOW,THEREFORE,BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL
OF THE CITY OF APACHE JUNCTION,ARIZONA,AS FOLLOWS:
Section 1.That the Water Utilities Community Facilities District
(City of Apache Junction,Arizona),hereinafter referred to as
"District",is hereby granted permission and given the consent of
the City of Apache Junction to enter into any and all agreements,of
whatsoever kind or nature,with persons outside the District to
provide water services to persons and property outside the District
boundaries,including but not limited to,the services of water
systems for domestic,industrial,irrigation,municipal or fire
protection purposes,including production,collection,storage,
treatment, transport, delivery, connection and disbursal.That this
permission and consent shall be considered authority for the
District to enter into any and all agreements for said services with
any persons or property located within the State of Arizona.
Section 2.That i t being necessary for the peace,health,and
safety of the City of Apache Junction,Arizona,an emergency is
declared to exist,and this resolution shall be effective
immediately upon its passage and adoption.
