HomeMy WebLinkAboutRES 95-26RESOLUTION NO.95-26 A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,ARIZONA,AUTHORIZING THE CREATION OF A TWENTY-EIGHT FOOT (28')WIDE PRIVATE ACCESS EASEMENT,IN CASE PA -1-95,FOR THE PURPOSE OF PROVIDING LEGAL ACCESS TO CERTAIN PARCELS DESCRIBED HEREIN AND ZONED GR (GENERAL RURAL). WHEREAS,a perpetual Private Access Easement described as follows: The South 28.0 feet of the East 325.0 feet of the West 358.0 feet of the North half of the Northeast quarter of the Northeast quarter of the Northeast quarter of Section 17;and the North 28.0 feet of the West 28.0 feet of the North half of the Southeast quarter of the Northeast quarter of the Northeast quarter of the Northeast quarter of Section 17,Township 1 North,Range 8 East of the Gila and Salt River Base and Meridian,Apache Junction,Pinal County,Arizona; has been requested in Case PA -1-95;and WHEREAS,said Private Access Easement is for the benefit of providing ingress and egress for the parcels described as follows: PARCEL "A":The West half of the North half of the Northeast quarter of the Northeast quarter of the Northeast quarter of Section 17,Township 1 North,Range 8 East of the Gila and Salt River Base and Meridian,Apache Junction,Pinal County,Arizona;and PARCEL "B":The East half of the North half of the Northeast quarter of the Northeast quarter of the Northeast quarter of Section 17,Township 1 North,Range 8 East of the Gila and Salt River Base and Meridian,Apache Junction,Pinal County,Arizona;and PARCEL "C":The North half of the Southeast quarter of the Northeast quarter of the Northeast quarter of the Northeast quarter of Section 17,Township 1 North,Range 8 East of the Gila and Salt River Base and Meridian,Apache Junction,Pinal County,Arizona;and WHEREAS,the creation of the Private Access Easement is necessary to provide legal access to the above described parcels,which previously had access onto those roadways known as W.Lost Dutchman Boulevard and N.Idaho Road,but lost their legal access due to the construction of certain flood control structures by the Maricopa County Flood Control District;and WHEREAS,the City of Apache Junction Planning and Zoning Commission did on September 26,1995,recommend approval of the Private Access Easement request;and RESOLUTION NO.95-26 PAGE ONE OF TWO WHEREAS,satisfactory evidence has been received to indicate that the requested Private Access Easement does not present a potential hazard to vehicular and/or pedestrian traffic;and WHEREAS,the requested Private Access Easement would not be detrimental to the public health,safety and welfare; NOW,THEREFORE,BE IT RESOLVED by the Mayor and City Council of the City of Apache Junction,Arizona,that the Private Access Easement,as described above,be approved subject to the following condition: 1.That the full length and width of the Private Access Easement be constructed with a chip seal surface or paving or ray binder or gravel,being crushed granite leveled and water- packed to provide a dust -free and relatively erosion -free surface for driving on,per the requirements of the City Engineer,as a condition to the approval of the Private Access Easement.
