HomeMy WebLinkAboutRES 95-27RESOLUTION NO.95-27 A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,DECLARING THAT CERTAIN FEDERALLY PATENTED EASEMENTS FOR PUBLIC RIGHT-OF-WAY PURPOSES DESCRIBED AS 6TH AVENUE BETWEEN WINCHESTER ROAD AND OLD WEST HIGHWAY,AND THE NORTH HALF OF 7TH AVENUE FROM WINCHESTER ROAD TO COLT ROAD.DESCRIBED IN ABANDONMENT CASE AB -95-02,ARE NO LONGER NECESSARY FOR PUBLIC USE AS ROADWAYS AND ARE HEREBY ABANDONED AND EXTINGUISHED AS PRESENT OR FUTURE PUBLIC RIGHTS -OF -WAY. WHEREAS,the requested abandonments are Federally Patented Easements for public rights -of -way purposes described as parcels of land located in Section 21, Township 1 North,Range 8 East,Gila and Salt River Base and Meridian,Apache Junction,Pinal County,and more particularly as follows: Part 1 -(adjacent to the south side of parcel # 101-20-014C) The South thirty-three feet (33')of the Southwest quarter of the Northwest quarter of the Southeast quarter of the Southwest quarter of Section 21,Township 1 North,Range 8 East of the Salt River Base and Meridian.Pinal County,Arizona,lying South of the South right-of-way lines of Old West Highway. EXCEPT THE WEST FORTY FEET (40') Part 2-(Adjacent to the north side of parcel # 101-20-018) The North Thirty-three feet (33')of the North half of the Southwest quarter of the Southeast quarter of the Southwest quarter of Section 21, Township 1 North,Range 8 East of the Salt River Base and Meridian,Pinal County,Arizona lying South of the South right-of-way line of Old West Highway . EXCEPT THE WEST FORTY FEET (40')THEREOF. Part 3-(adjacent to the south side of parcel # 101-20-018) The South Thirty-three feet (33')of the North half of the Southwest quarter of the Southeast quarter of the Southwest quarter of Section 21, Township 1 North,Range 8 East of the Salt River Base and Meridian,Pinal County,Arizona lying South of the South right-of-way line of Old West Highway . EXCEPT THE WEST FORTY FEET (40')THEREOF. Resolution No.95-27 Page One of Two WHEREAS,the abandonments requested,if approved,would not leave a parcel in separate ownership without access to an established public roadway connecting such lands with another public roadway,or have access by a Federally Patented Easement which may in the future be developed;and WHEREAS,the City Council of The City of Apache Junction,Arizona,finds that said Federally Patented Easements for public rights -of -way purposes as described herein,are classified as local streets on the Street Classification Plans,and are no longer necessary for public use as roadways. NOW,THEREFORE,BE IT RESOLVED by the Mayor and City Council of the City of Apache Junction,Arizona,that the above -described Federally Patented Easements reserved for public rights -of -way purposes are hereby extinguished and abandoned as present or future public rights -of -way. BE IT FURTHER RESOLVED that the abandonment of the public right-of-way has no effect on the reservations for public utility easements.
