HomeMy WebLinkAboutRES 95-30RESOLUTION NO.95-30 A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA, APPROVING GENERAL PLAN AMENDMENT GPA-95-01, A PROPOSAL TO AMEND THE 1995 GENERAL PLAN LAND USE MAP BY REDESIGNATING FROM "MEDIUM DENSITY RESIDENTIAL"TO "HIGH DENSITY RESIDENTIAL"IN THE AREA IN SECTION 30 NORTH OF SOUTHERN AVENUE 660 FEET AND WEST OF IRONWOOD DRIVE. WHEREAS,the Apache Junction City Council did on March 7,1995,adopt the 1995 Apache Junction General Plan;and WHEREAS,the subject site affected by increasing the density designation is an area 20 gross acres in size,bounded by Ironwood Drive on the east,the 20th Avenue alignment to the north,and is approximately 660 feet north of Southern Avenue;and WHEREAS,the subject area considered for the increase to high density in Section 30 is legally described as: The North half of the Southeast quarter of the Southeast quarter of Section 30,Township 1 North,Range 8 East,Gila and Salt River Base and Meridian,Apache Junction,Pinal County,Arizona;and WHEREAS,the Apache Junction Planning and Zoning Commission held a public hearing regarding GPA-95-01 on October 10,1995;and WHEREAS,the Apache Junction Planning and Zoning Commission recommended approval of GPA-95-01;and WHEREAS,this Council has complied with the requirements for the preparation and adoption of a General Plan Amendment pursuant to A.R.S.9-461.05; and WHEREAS,this Council finds that the action taken on this General Plan Amendment is necessary for sound and orderly community development,for preservation of community values,and for the promotion of the general health, safety,convenience and welfare of the citizens of the Apache Junction community; and WHEREAS,this Council finds that increasing the density designation in the Section 30 subject area would be largely compatible with the existing land uses; and WHEREAS,this Council has considered the findings of fact given in Section D.1.6 of the 1995 Apache Junction General Plan and finds: RESOLUTION NO.95-30 PAGE ONE OF TWO A.That the amendment constitutes an overall improvement to the General Plan and is not solely for the good and benefit of a particular landowner or owners at a particular point in time. B.That the amendment will not adversely impact the community as a whole or a portion of the community by: I .Significantly altering acceptable existing land use patterns; II.Requiring larger and more expensive improvements to roads, sewer or water systems than are needed to support the prevailing land uses and which,therefore,may impact development of other lands; III.Adversely impacting existing uses because of increased traffic on existing systems;or IV.Affecting the livability of the area or the health and safety of the residents. C.That the amendment is consistent with the overall intent of this General Plan. NOW,THEREFORE,BE IT RESOLVED by the Mayor and City Council of the City of Apache Junction,Arizona, that case GPA-95-01,a General Plan Amendment proposing to amend the 1995 General Plan Land Use Map by increasing the density designation to high density in an area of Section 30,be approved and adopted.
