HomeMy WebLinkAboutRES 95-12RESOLUTION NO.95-12 A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA, APPROVING PRELIMINARY SUBDIVISION PLAT SD -95-01, ARROYO VERDE, BY LENNAR HOMES. WHEREAS,the subdivider in case SD -95-01 proposes to subdivide 62 acres in the South half of the Northwest quarter of Section 29, T.1 N.,R. 8 E.,Gila and Salt River Base and Meridian,Pinal County,Arizona,into 218 residential lots pursuant to Article 6.2 of Chapter 4 of Title 9,Arizona Revised Statutes,and pursuant to the Apache Junction Subdivision Regulations;and WHEREAS,the Apache Junction Planning and Zoning Commission held a public hearing regarding SD -95-01 on May 9,1995 and recommended approval of SD -95-01 by a vote of 5 to 0;and WHEREAS, this Council finds this proposed subdivision to be consistent with the Medium Density designation of the Apache Junction General Plan;and WHEREAS,this Council finds this proposed subdivision to be in compliance with the Apache Junction Zoning Ordinance and the Apache Junction Subdivision Regulations;and WHEREAS,this Council finds that the stipulations required for this subdivision are necessary for sound and orderly community development,for preservation of community values and for the promotion of the general health, safety,convenience,and welfare of the citizens of Apache Junction. NOW,THEREFORE,BE IT RESOLVED by the Mayor and City Council of the City of Apache Junction,Arizona,that: Said preliminary subdivision plat, SD -95-01, Arroyo Verde, be conditionally approved subject to the following stipulations and conditions: A.PLANS AND SPECIFICATIONS: 1.The subdivider shall submit plans and specifications for all public improvements within public rights -of -way and public easements to the City Engineer for approval. 2.Below -surface utilities shall be installed before the installation of concrete curbs, gutters,and sidewalks,and the surfacing of the streets. 3.Sight distance requirements at all public street intersections shall conform to the intersectional sight distance criteria as provided by the American Association of State Highway Officials or to the satisfaction of the City Engineer. RESOLUTION NO.95-12 PAGE ONE OF THREE 4.Unless otherwise provided for by the City Engineer,the Apache Junction Development Guide standards shall apply in preparing improvement plans irrespective of what is shown on the approved preliminary plat. 5.Construct,or agree to construct,the public improvements shown on the improvement plans as approved by the City Engineer. B.GRADING PLANS: 6.Prior to any grading on the site and prior to issuance of any required grading permit,the subdivider shall submit grading plans and any grading permit/plan review fees to the City Engineer for approval. 7.Subdivider shall commit to a strategy,approved by the City Engineer,to suppress emissions of dust where there is clearing, blading,or disturbing of land. C.SANITATION: 8.Subdivider shall provide and obtain commitment for sewer service to all lots from the Superstition Mountain Community Facilities District prior to obtaining final plat approval by the City Council. D.FINAL PLAT: 9.Dedicate all rights -of -way and easements shown on the final plat or as required by the City Engineer. 10.Lot design and street alignments on the final plat shall be in substantial conformance to that shown on the approved preliminary plat. 11.Proposed street names shall comply with the City's street naming policy. 12.Proposed retention basin shall be dedicated to the City. E.OTHER CONDITIONS: 13.This subdivision shall be placed in a street light improvement district to energize,maintain,and operate the street lighting system installed by the subdivider. 14.The approval of this preliminary subdivision plat expires in 12 months on June 20,1996. The subdivider must comply with the adopted stipulations and file a complete final plat application before this date or request a time extension for an additional 12 months. RESOLUTION NO.95-12 PAGE TWO OF THREE 15.Landscaping plans for the open space/drainage/retention area shall be submitted to the Parks and Recreation Director and to the City Engineer for approval;and the subdivider shall improve or agree to improve the open space/drainage/retention area prior to its dedication to the City by revegetating the wash and augmenting the landscaping with native desert materials,by constructing an 8 -foot stabilized granite walkway the entire distance of the east/west wash and by providing bank stabilization where required by the hydrology study and as approved by the City Engineer and Parks and Recreation Director. 16.The subdivider shall be required to obtain approval of a Planned Development overlay zone in order to obtain setback reductions if such setback reductions are requested by the subdivider/developer. 17.The subdivider shall be required to comply with all other applicable city codes,policies,and requirements.
