A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,
ARIZONA,APPROVING PRELIMINARY SUBDIVISION PLAT SD -96-02,IDAHO AND SUPERSTITION
COMMERCIAL,BY IDAHO FREEWAY ASSOCIATES.
WHEREAS,the subdivider in case SD -96-02 proposes to subdivide 8.28 acres
in the South Half of the North Half of the Southwest Quarter of the Northwest
Quarter of Section 33,T.1 N.,R.8 E.,Gila and Salt River Base and Meridian,
Pinal County,Arizona,into 6 commercial lots pursuant to Article 6.2 of Chapter
4 of Title 9,Arizona Revised Statutes,and pursuant to the Apache Junction
Subdivision Regulations;and
WHEREAS,the Apache Junction Planning and Zoning Commission held a public
hearing regarding SD -96-02 on May 14,1996 and recommended approval of the
subdivision by a vote o f 5 to 0;and
WHEREAS, this Council finds this proposed subdivision to be consistent with
Policy A -2c (discouraging the creation of parcels without off -site public
improvements),Objective B-4 (creating attractive commercial districts compatible
with adjacent uses),and Policy B -4c and Implementation Guideline page 106
(encouraging commercial development at nodes)of the Apache Junction General
Plan;and
WHEREAS,this Council finds this proposed subdivision to be in compliance
with the Apache Junction Zoning Ordinance pursuant to Ordinance Numbers 933 and
946 granting C-3/PD zoning for this site and with the Apache Junction Subdivision
Regulations;and
WHEREAS,this Council finds that this subdivision is in an area designated
as having an assured water supply in compliance with ARS 9-463.01(1);and
WHEREAS,this Council finds that the stipulations required for this
subdivision are necessary for sound and orderly community development,for
preservation of community values and for the promotion of the general health,
safety,convenience,and welfare of the citizens of Apache Junction;and
NOW,THEREFORE,BE IT RESOLVED by the Mayor and City Council of the City
of Apache Junction,Arizona,that:
Said preliminary subdivision plat,SD -96-02,Idaho and Superstition
Commercial,be conditionally approved subject to the following stipulations and
conditions:

A.PLANS AND SPECIFICATIONS:
1.The subdivider shall submit plans and specifications for all public
improvements within public rights -of -way and public easements to the
City Engineer for approval.
2.Below -surface utilities shall be installed before the installation
of concrete curbs,gutters,and sidewalks,and the surfacing of the
streets.
3.Sight distance requirements at all public street intersections to
conform to the intersectional sight distance criteria as provided by
the American Association of State Highway Officials or to the
satisfaction of the City Engineer.
4.Unless otherwise provided for by the City Engineer,the standards in
the Apache Junction Engineering Guidelines shall apply in preparing
improvement plans irrespective of what is shown on the approved
preliminary plat.
5.The subdivider shall construct,or agree to construct,the public
improvements shown on the improvement plans as approved by the City
Engineer.
B.GRADING PLANS:
6.Prior to any grading on the site and prior to issuance of any
required grading permit,the subdivider shall submit grading plans
and any grading permit/plan review fees to the City Engineer for
approval.
7.Subdivider shall commit to a strategy,approved by the City
Engineer,to suppress emissions of dust where there is clearing,
blading,or disturbing of land.
C.SANITATION:
8.Subdivider shall obtain written commitment for sewer service to all
lots from the Superstition Mountain Community Facilities District
prior to obtaining final plat approval by the City Council.
9.Subdivider shall obtain written commitment for water service to all
lots from the Apache Junction Water Utilities Community Facilities
District prior to obtaining final plat approval by the City Council.
D.FINAL PLAT:
10.Dedicate any and all rights -of -way and easements shown on the final
plat or as required by the City Engineer.

11.Lot design and street alignments on the final plat shall be in
substantial conformance to that shown on the approved preliminary
plat.
12.Each lot to provide retention volume for its gross area.
E.OTHER CONDITIONS:
13.The approval of this preliminary subdivision plat expires in 12
months on June 4,1997.The subdivider must comply with the above-
referenced stipulations and file a complete final plat application
before this date or request a time extension for an additional 12
months.
14.Landscaping plans for the rights -of -way shall be submitted to the
City Engineer for approval as each parcel is proposed for
development and the landscaping shall be installed to the
satisfaction of the City Engineer prior to its acceptance by the
City and issuance of the certificate of occupancy.
15.The subdivider is required to comply with all other applicable city
codes,policies,and requirements.
