A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,
ARIZONA,DECLARING THAT A CERTAIN DEDICATED RIGHT-OF-WAY DESCRIBED AS A
PORTION OF 20TH AVENUE AND A PORTION OF PALO VERDE DRIVE DESCRIBED IN
ABANDONMENT CASE AB -96-01 ARE NO LONGER NECESSARY FOR PUBLIC USE AS
ROADWAYS AND ARE HEREBY VACATED AS A PRESENT OR FUTURE PUBLIC
RIGHT-OF-WAY.
WHEREAS,the requested vacation are Dedicated rights -of -way for public
rights -of -way purposes described as a parcel of land located in Section 30,
Township 1 North,Range 8 East,Gila and Salt River Base and Meridian,Apache
Junction,Pinal County,and more particularly as follows:
Part 1 -(Portion of That Right-of-way Recorded in Docket 1152 Page 878 P.C.R.)
A Portion of That Right-of-way as Recorded in That Certain Quit Claim Deed
Recorded in Docket 1152 Page 878,Pinal County Records,Located in a Portion of
the Southeast Quarter of Section 30,Township 1 North,Range 8 East,of the Gila
and Salt River Base and Meridian,City of Apache Junction,Pinal County, Arizona,
Described as Follows:
Commencing at the Southeast Corner of Section 30;
Thence North 0000023"West a distance of 1320.70 feet along the East line of
Section 30 to the Southeast corner of the Northeast quarter of the Southeast
quarter of Section 30:
Thence South 89°56'16" West a distance of 358.56 feet along the South line of the
Northeast quarter of the Southeast quarter of Section 30 to the Point of
Beginning,Said Point lying on a non -tangent curve,concave Northeast,from which
the radius bears North 29°51'51"East a distance of 225.00 feet:
Thence Northwesterly 50.69 feet along the arc of said curve through a central
angle of 12°54'25" to a point on the North line of the South 30.00 feet of the
Northeast quarter of the Southeast quarter of Section 30:
Thence South 89°56'16" West a distance of 43.29 feet along said North line to the
beginning of a non -tangent curve,concave Northwest,from which the radius bears
North 30°53'51"West a distance of 425.00 feet;
Thence Southwesterly 67.88 feet along the arc of said curve through a central
angle of 9°09'03" to a point on the South line of the Northeast quarter of the
Southeast quarter of Section 30;
Thence North 89°56'16" East a distance of 144.82 feet to the Point of Beginning.

Described as follows:
Commencing at the Southeast corner of Section 30;
Thence North 00°00'23 -West a distance of 1320.70 feet along the East line of

Thence South 89°56'16"West a distance of 1035.34 feet along the South line of

the beginning of a non -tangent curve,concave Northwest,from which the radius
bears North 01°08'44" West a distance of 425.00 feet:
Thence Northeasterly 152.81 feet along the arc of said curve through a central
angle of 20°36'04" to a point on the North line of the Southeast quarter of the
Southeast quarter of Section 30:
Thence North 89°56'16" East a distance of 144.82 feet to the Point of Beginning.
WHEREAS,the vacation requested,if approved,would not leave a parcel in
separate ownership without access to an established public roadway connecting
such lands with another public roadway,or have access by a Federally Patented
Easement which may in the future be developed:and
WHEREAS,the City Council of The City of Apache Junction,Arizona,finds
that said Dedicated Rights -of -way for public rights -of -way purposes as described
herein,are classified as local streets by the City of Apache Junction,and are
no longer necessary for public use as streets.
WHEREAS,the right-of-way described as Part 1 is hereby vacated to the
benefit of that parcel of land described as Pinal County Assessors parcel number
102-11-001J records of Pinal County, Arizona.The right-of-way described as Part
2 herein is hereby vacated to the benefit of that parcel of land described as
parcel number 102-44-003A records of Pinal County,Arizona,pursuant to the
applicable provisions of Arizona law.
NOW,THEREFORE,BE IT RESOLVED by the Mayor and City Council of the City
of Apache Junction,Arizona,that the above -described Dedications reserved for
public rights -of -way purposes are hereby extinguished and vacated as present or
future public rights -of -way.
BE IT FURTHER RESOLVED that the vacation of the public right-of-way
eliminates the reservations for public utility easements.
