A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY
OF APACHE JUNCTION,ARIZONA,APPROVING AN INTERGOVERN-
MENTAL AGREEMENT BETWEEN THE WATER UTILITIES COMMUNITY
FACILITIES DISTRICT (CITY OF APACHE JUNCTION,ARIZONA)
AND THE CITY OF APACHE JUNCTION,ARIZONA,FOR THE
PROVISION OF CONSTRUCTION AND MAINTENANCE SERVICES
WHEREAS,the Water Utilities District (City of Apache Junction,
Arizona),a political subdivision of the State of Arizona
(hereinafter referred to as "WUCFD"),and the City of Apache
Junction,a municipal corporation of the State of Arizona
(hereinafter referred to as "Apache Junction")are empowered by
A.R.S.§11-952 to enter into intergovernmental agreements for joint
or cooperative action;and
WHEREAS,pursuant to A.R.S.§§48-709,9-240 and 9-246,WUCFD and
Apache Junction have the power to enter into the specific terms and
conditions of the intergovernmental agreement attached hereto and by
this reference incorporated herein;and
WHEREAS,the health,safety and welfare of the public will be served
by the entry into said intergovernmental agreement:
NOW,THEREFORE,BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL
OF THE CITY OF APACHE JUNCTION,ARIZONA,AS FOLLOWS:
Section 1.That the intergovernmental agreement attached hereto and
by this reference incorporated herein is hereby approved and
authority is granted to the City of Apache Junction to enter into
said intergovernmental agreement.
Section 2.That the City Manager is hereby authorized to execute
said intergovernmental agreement on behalf of the City of Apache
Junction.
APPROVED AND ADOPTED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF
APACHE JUNCTION,ARIZONA,THIS 17TH DAY OF SEPTEMBER ,1996.
