HomeMy WebLinkAboutRES 96-03RESOLUTION NO.96-03 A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,ARIZONA,LIFTING A MORATORIUM ON THE ISSUANCE OF PERMITS FOR BUILDING AND CONSTRUCTION IN THE SIERRA ENTRADA CERTIFICATED AREA CONDITIONED UPON CONNECTION TO SEWER SERVICE PROVIDED BY SUPERSTITION MOUNTAINS COMMUNITY FACILITIES DISTRICT NO.1 WHEREAS, on January 5, FM,the Apache Junction City Council found it necessary to deny all building permit applications in the Sierra Entrada Certificated Area due to non-compliance on the part of the service provider,American Public Service;and WHEREAS,the continued non-compliance on the part of American Public Service would not allow the city to issue building permits or the Arizona Department of Environmental Quality to permit new sewer hook-ups;and WHEREAS,both residential and commercial property owners have been restricted from full use of their property and have been economically deprived as a result; and WHEREAS,the combined efforts of the City of Apache Junction,the Superstition Mountains Community Facilities District No.1,the Arizona Department of Environmental Quality, and the Sierra Entrada area property owners have affected a resolution that will allow for the continued development of this area. NOW,THEREFORE,BE IT RESOLVED by the Mayor and City Council of the City of Apache Junction, Arizona,that the moratorium on the issuance of building permits in the Sierra Entrada Certificated Area is hereby lifted as to building and construction,which will connect to the sewer service provided by Superstition Mountains Community Facilities District No.1. PASSED AND ADOPTED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,THIS 6THDAY OF FEBRUARY ,1996. SIGNED AND ATTESTED TO THIS 7THDAY OF FEBRUARY ,1996.
