HomeMy WebLinkAboutRES 96-11RESOLUTION NO.96-11 A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,APPROVING PRELIMINARY SUBDIVISION PLAT SD -1-96,RENAISSANCE POINT,BY CANTERBURY HOMES,LAS VEGAS. WHEREAS,the subdivider in case SD -1-96 proposes to subdivide 67 acres in the Southeast quarter of Section 30,Township 1 North,Range 8 East,Gila and Salt River Base and Meridian,Pinal County,Arizona,into 297 residential lots pursuant to Article 6.2 of Chapter 4 of Title 9,Arizona Revised Statutes,and pursuant to the Apache Junction Subdivision Regulations;and WHEREAS,the Apache Junction Planning and Zoning Commission held a public hearing regarding SD -1-96 on April 23,1996 and recommended approval of SD -1-96 by a vote of 3 to 2;and WHEREAS,this Council finds this proposed subdivision to be consistent with the Medium Density designation of the Apache Junction General Plan;and WHEREAS,this Council finds this proposed subdivision to be in compliance with the Apache Junction Zoning Ordinance and the Apache Junction Subdivision Regulations;and WHEREAS,this Council finds that the stipulations required for this subdivision are necessary for sound and orderly community development,for preservation of community values and for the promotion of the general health, safety,convenience,and welfare of the citizens of Apache Junction. NOW,THEREFORE,BE IT RESOLVED by the Mayor and City Council of the City of Apache Junction,Arizona,that: Said preliminary subdivision plat,SD -1-96,Renaissance Point,be conditionally approved subject to the following stipulations and conditions: 1.Abandonment of a portion of an existing 30'road right-of-way adjacent to the west and south sides of Tract A and along the south side of Tract F must be processed to conclusion by the City prior to final plat approval. 2.A 50'roadway easement for Delaware is to be maintained. 3.Any landscaping to be provided along the Ironwood,Delaware and 16th Avenue rights -of -way shall be maintained by the Homeowner's Association. RESOLUTION NO.96-11 PAGE ONE OF THREE 4.The "Typical Building Layout"diagrams shall reflect 45 -foot -wide minimum lots with 3 -foot and 7 -foot minimum side yards. 5.The final plat shall state that Tracts A through E shall be dedicated to the City.Tract F may be covered by C.C.and R.s or given to Careage to include in their site plans. 6.Lots 295 through 297 shall be included within Phase II. 7.The south half of 16th Avenue improvements shall be included within Phase II. 8.All clearing,shaping,irrigation,stabilization and vegetation for the full width of the wash shall be finished with Phase II. 9.The subdivision may be developed in three phases,with Phase I,as depicted,being the first to be submitted for final plat approval. 10.Phase I underground utilities which may cross unsubdivided lands west to Delaware shall have easements properly recorded. 11.All of the street names shall be as depicted on the submitted street name concept plan,including Renaissance Avenue which represents a deviation from the city's normal street naming plan. 12.Landscaping plans for the linear park shall be coordinated with the city's Parks and Recreation Department.
