A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,
ARIZONA,APPROVING THE FINAL SUBDIVISION PLAT SD -97-01,CIMMARRON SUBDIVISION,
BY COMMUNITIES SOUTHWEST,PHOENIX,ARIZONA.
WHEREAS,the subdivider in case SD -97-01 proposes to subdivide 61.37
acres in the Northwest quarter of the Northeast quarter of the North half of
the Southwest quarter of the Northeast quarter of Section 33,Township 1
North,Range 8 East,Gila and Salt River Base and Meridian,Pinal County,
Arizona,into 267 residential lots pursuant to Article 6.2 of Chapter 4 of
Title 9.Arizona Revised Statutes,and pursuant to the kache Junction
Subdivision Regulations;and
WHEREAS,the Apache Junction Planning and Zoning Commission held a
public hearing regarding SD -97-01 on March 25,1997 and recommended approval
of SD -97-01 by a vote of 6 to 0;and
WHEREAS,the Council held a public hearing regarding SD -97-01 on May 6,
1997 and approved the preliminary plat pursuant to Resolution 97-13 by a 7 to
0 vote;and
WHEREAS,this Council finds this proposed subdivision to be consistent
with the Medium Density designation of the Apache Junction General Plan;and
WHEREAS,this Council finds this proposed subdivision to be in
compliance with the Apache Junction Zoning Ordinance pursuant to Ordinance
No.991 (companion case PZ-97-01)granting CR-3/PD zoning for this site and the
Apache Junction Subdivi si on Regul ations ;and
WHEREAS,this Council finds that the stipulations required for this
subdivision are necessary for sound and orderly community development,for
preservations of community values and for the promotion of the general health,
safety,convenience,and welfare of the citizens of Apache Junction.
NOW,THEREFORE,BE IT RESOLVED by the Mayor and City Council of the City
of Apache Junction, Arizona,that:

Said final subdivision plat,SD -97-01,Cimmarron,be conditionally
approved subject to the following stipulations and conditions:
1.All outstanding stipulations and conditions of Resolution 97-13
that are i n effect will still apply.
2.Any proposed alterations to the approved landscaping plans for
Cimmarron Subdivision must be submitted to the City for review and
approval by the Parks and Recreation Department.
3.The Weekes Wash drainage channel will have the following six items
addressed,to the satisfaction of the City Engineer:
A.Grade side banks of the wash to conform the existing
channel at Southern Avenue.
B.Construct a drop structure at Southern Avenue.
C.Add drop structures per Pinal County Flood Control District
Plans or approved alternative.
D.Install permanent repair at outlet to the Arizona Department
of Transportation (ADOT)retention basin.
E.Stabilize side and bottom slopes.
F.Stabilize drainage outlets entering the wash from the
property to the east.
4.Written acknowledgment from ADOT that a permit will be issued for
work within the ADOT right-of-way.
5.The final plat for Cimmarron Subdivision will not be recorded
until all outstanding stipulations and conditions have been met.
