HomeMy WebLinkAboutRES 97-45RESOLUTION NO.97-45 A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,ARIZONA,APPROVING A PRELIMINARY SUBDIVISION PLAT,CASE SD -97-11,FOR BASELINE INDUSTRIAL PARK SUBDIVISION,BY MONTY AND CLARA NICHOLS. WHEREAS,the subdivider in case SD -97-11 proposes to subdivide +/-58 acres in the Southwest quarter area of Section 33,Township 1 North,Range Eight East of the Gila and Salt River Base and Meridian,Pinal County,Arizona,into +/-50 industrial lots pursuant to Article 6.2 of Chapter 4 of Title 9, Arizona Revised Statutes,and pursuant to the Apache Junction Subdivision Regulations;and WHEREAS,the Apache Junction Planning and Zoning Commission held a public hearing regarding SD -97-11 on November 25,1997,and recommended denial of SD -97-11 by a vote of 7 to 0;and WHEREAS,this Council finds this proposed subdivision to be in compliance with the Industrial and Open Space designations of the Apache Junction General Plan;and WHEREAS,this Council finds this proposed subdivision to be in compliance with the Apache Junction Zoning Ordinance and the Apache Junction Subdivision Regulations;and WHEREAS,this Council finds that the stipulations required for this subdivision are necessary for sound and orderly community development,for preservation of community values and for the promotion of the general health, safety,convenience and welfare of the citizens of Apache Junction. NOW,THEREFORE,BE IT RESOLVED by the Mayor and City Council of the City of Apache Junction,Arizona,that: Said preliminary subdivision plat,SD -97-11,Baseline Industrial Park,be conditionally approved subject to the following stipulations and conditions: 1)An extension of the water distribution system shall be in place,including water lines adequate enough to handle necessary fire flows,before occupancy permits for businesses in the platted subdivision shall be issued. 2)Appropriate structures for drainage and all-weather access purposes shall be constructed where necessary, as determined by the City Engineer,the Public Works Director and the Fire District. RESOLUTION NO.97-45 PAGE 1 OF 2 3)The developer shall coordinate and construct all on -site and off -site improvements (roads,curbing,sidewalks, gutters,streetlights,retention basins,drainage easements, etc.)to the City Engineer's standards. 4)On -site retention basins must meet City requirements for 10 -year 24 hour storm.All retention basins shall incorporate curvilinear layouts and shall avoid straight side slopes with only rounded corners. 5)Internal development street lighting must be initiated by the property owner to create an improvement district. 6)Lots in the Baseline Industrial Park Subdivision may be combined,but any further division of any platted lot shall require a subdivision plat amendment process. 7)All open space tracts/landscape areas are to be maintained by individual property owners.All open space tracts/landscape areas are to comply with the provisions of Ordinance No.940 and shall be kept clean and well maintained at all times.
