HomeMy WebLinkAboutRES 97-02RESOLUTION NO.97-02 A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,APPROVING PRELIMINARY SUBDIVISION PLAT SD -96-06,IRONWOOD AND SOUTHERN, BY DIAMOND KEY HOMES. WHEREAS,the subdivider in case SD -96-06 proposes to subdivide 127 acres in the Southwest Quarter of Section 29,T.1 N.,R.8 E.,Gila and Salt River Base and Meridian,Pinal County,Arizona,into 563 residential lots pursuant to Article 6.2 of Chapter 4 of Title 9,Arizona Revised Statutes,and pursuant to the Apache Junction Subdivision Regulations;and WHEREAS,the Apache Junction Planning and Zoning Commission held a public hearing regarding SD -96-06 on January 14,1997 and recommended approval of the subdivision by a vote o f 3 to 1;and WHEREAS,the City Council finds this proposed subdivision to be consistent with Objective A-2 (which encourages the development of land within the City which is already served by public facilities and utilities),with Goal B (which seeks to develop sound and stable neighborhoods),with Objective F-1 (which encourages new housing developments that offer a range of new housing types and sizes in the Apache Junction market),and with the Planned Area Development (3.5 to 5.5 dwelling units per acre)designation of the Apache Junction General Plan; and WHEREAS,this Council finds this proposed subdivision to be in compliance with the Apache Junction Zoning Ordinance pursuant to Ordinance Number 979 (companion case PZ-96-22)granting CR-3/PD zoning for this site and with the Apache Junction Subdivision Regulations;and WHEREAS,this Council finds that the stipulations required for this subdivision are necessary for sound and orderly community development,for preservation of community values and for the promotion of the general health, safety,convenience,and welfare of the citizens of Apache Junction;and NOW,THEREFORE,BE IT RESOLVED by the Mayor and City Council of the City of Apache Junction,Arizona,that: Said preliminary subdivision plat,SD -96-06,Ironwood and Southern,be conditionally approved subject to the following stipulations and conditions: A.PLANS AND SPECIFICATIONS: 1.The subdivider shall submit plans and specifications for all public improvements within public rights -of -way and public easements to the City Engineer for approval. RESOLUTION NO.97-02 PAGE ONE OF THREE 2.Below -surface utilities shall be installed before the installation of concrete curbs,gutters,and sidewalks,and the surfacing of the streets. 3.Sight distance requirements at all public street intersections to conform to the intersectional sight distance criteria as provided by the American Association of State Highway Officials or to the satisfaction of the City Engineer. 4.Unless otherwise provided for by the City Engineer,the standards in the Apache Junction Engineering Guidelines shall apply in preparing improvement plans irrespective of what is shown on the approved preliminary plat. 5.Construct,or agree to construct with secured assurances,the public improvements shown on the improvement plans as approved by the City Engineer. B.GRADING PLANS: 6.Prior to any grading on the site and prior to issuance of any required grading permit,the subdivider shall submit grading plans and any grading permit/plan review fees to the City Engineer for approval. 7.Subdivider shall commit to a strategy,approved by the City Engineer,to suppress emissions of dust where there is clearing, blading,or disturbing of land. C.HEALTH AND SANITATION: 8.Subdivider shall obtain commitment for sewer service to all lots from the Superstition Mountain Community Facilities District No.I prior to obtaining final plat approval by the City Council. 9.Subdivider shall ,prior to final plat approval by the City Council, obtain certification from the Arizona Department of Water Resources that this subdivision is in an area designated as having an assured water supply in compliance with ARS 9-463.01(1). D.FINAL PLAT: 10.Dedicate any and all rights -of -way and easements shown on the final plat or as required by the City Engineer. 11.Lot design and street alignments on the final plat shall be in substantial conformance to that shown on the approved preliminary plat. RESOLUTION NO.97-02 PAGE TWO OF THREE 12.Farwest Drive be renamed South Pinto Drive,18th Lane be renamed West 18th Avenue,18th Avenue be renamed West Mesquite Avenue, Navajo Avenue be renamed Diamond Avenue or an alternate acceptable to the City Council,20th Lane be renamed West Montebello Avenue, Copper Drive be renamed South Coyote Drive,and Gold Circle be renamed South Valley Drive. E.OTHER CONDITIONS: 13.This subdivision shall be placed in a street light improvement district to energize,maintain,and operate the street lighting system installed by the subdivider. 14.The approval of this preliminary subdivision plat expires in 12 months on February 4,1998.The subdivider must comply with the above -referenced stipulations and file a complete final plat application before this date for Phase One and for the final phase by February 4,2000 or request a time extension for an additional 12 months. 15.The open space landscaping plans,improvements,and irrigation systems be approved by the Parks and Recreation Director,installed by the developer and maintained by the homeowners association. 16.The subdivider is required to comply with all other applicable city codes,policies,and requirements.
