A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,
ARIZONA,APPROVING A PRELIMINARY SUBDIVISION PLAT,CASE SD -97-02,FOR CORTEZ
RANCH SUBDIVISION,BY VITAL LIVING INTERNATIONAL,INC.
WHEREAS,the subdivider in case SD -97-02 proposes to subdivide 40 acres in
the Southwest quarter area of Section 34,Township 1 North,Range Eight East of
the Gila and Salt River Base and Meridian,Pinal County,Arizona,into ±177
residential lots pursuant to Article 6.2 of Chapter 4 of Title 9, Arizona Revised
Statutes,and pursuant to the Apache Junction Subdivision Regulations;and
WHEREAS,the Apache Junction Planning and Zoning Commission held a public
hearing regarding SD -97-02 on April 22,1997,and recommended approval of SD -97-
02 by a vote of 3 to 1;and
WHEREAS, this Council finds this proposed subdivision to not be in conflict
with the High Density,Open Space and Industrial designations of the Apache
Junction General Plan;and
WHEREAS,this Council finds this proposed subdivision to be in compliance
with the Apache Junction Zoning Ordinance and the Apache Junction Subdivision
Regulations;and
WHEREAS,this Council finds that the stipulations required for this
subdivision are necessary for sound and orderly community development,for
preservation of community values and for the promotion of the general health,
safety,convenience and welfare of the citizens of Apache Junction.
NOW,THEREFORE,BE IT RESOLVED by the Mayor and City Council of the City
of Apache Junction,Arizona,that:
Said preliminary subdivision plat,SD -97-02, Cortez Ranch, be conditionally
approved subject to the following stipulations and conditions:
1)The developer shall extend any necessary Water District water lines
to service the site.A 12 -inch main shall be installed along the
site's Baseline Avenue frontage and lines shall be looped from the
existing valve on Cortez,north of the northeast property corner,to
Baseline.
2)The developer shall coordinate and construct all on -site and off-
site improvements (roads,curbing, sidewalks, gutters, streetlights,
retention basins,drainage easements,etc.)to the City Engineer's
standards.

3)All open space tracts/parkway areas are to be maintained by the
subdivision's homeowners association.All open space tracts/parkway
areas are to comply substantially with the "H.O.A.Maintained Open
Space Standards",as required by the city's Parks and Recreation
Department.
4)The 36th Lane intersection with Cortez must line up with the Rancho
Mirage M.H.Park entrance to the east,or be offset with said
entrance a minimum of 250 feet (to be shown on final plat).
5)39th Court shall be renamed 39th Avenue.
6)A future extension to the west for 36th Avenue should be planned
with this project (i.e.,stub out 36th Avenue at the west property
line).The final plat and improvement plans shall show the cul-de-
sac and additional right-of-way needed to provide an extension to
the west if needed.
7)Delete the northerly street stub at Bowman.
8)As a result of stipulations 4 through 7,as stated above,the
overall street pattern on the final plat shall reflect a more
curvilinear design.
