HomeMy WebLinkAboutRES 97-15RESOLUTION NO.97-15 A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,APPROVING A PRELIMINARY SUBDIVISION PLAT,CASE SD -97-04,FOR DELONG SUB SUBDIVISION,BY KERMIT DELONG AND GLORIA WEBER. WHEREAS,the subdivider in case SD -97-04 proposes to subdivide 0.81 gross acres in the Northwest quarter area of Section 30,Township One North,Range Eight East of the Gila and Salt River Base and Meridian,Pinal County,Arizona, into 3 residential lots pursuant to Article 6.2 of Chapter 4 of Title 9,Arizona Revised Statutes,and pursuant to the Apache Junction Subdivision Regulations; and WHEREAS,the Apache Junction Planning and Zoning Commission held a public hearing regarding SD -97-04 on May 27,1997,and recommended approval of SD -97-04 by a vote of 7 to 0;and WHEREAS,this Council finds this proposed subdivision to not be in conflict with the "Medium Density/1 to 6 Dwelling Units per acre/Conventional or Manufactured Homes permitted",designation of the Apache Junction General Plan; and WHEREAS,this Council finds this proposed subdivision to be in compliance with the Apache Junction Zoning Ordinance and the Apache Junction Subdivision Regulations;and WHEREAS,this Council finds that the stipulations required for this subdivision are necessary for sound and orderly community development,for preservation of community values and for the promotion of the general health, safety,convenience and welfare of the citizens of Apache Junction. NOW,THEREFORE,BE IT RESOLVED by the Mayor and City Council of the City of Apache Junction,Arizona,that: Said preliminary subdivision plat,SD -97-04,DeLong Sub,be conditionally approved subject to the following stipulations and conditions: 1)All new homes proposed for construction or installation on the newly created lots shall comply with the written TN (Trailer Homesites)Zone setbacks at the time of construction or installation;currently as follows: a)Front yard:20 feet b)Rear yard:20 feet c)Side yard:10 feet RESOLUTION NO.97-15 PAGE 1 OF 2 2)Any existing nonconforming situations,including setback encroachments, shall be resolved before the final plat can be approved.
