HomeMy WebLinkAboutRES 97-26RESOLUTION NO.97-26 A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,ARIZONA,APPROVING A PRELIMINARY SUBDIVISION PLAT,CASE SD -97-03,FOR IRONWOOD ESTATES SUBDIVISION,BY VITAL LIVING INTERNATIONAL,INC. WHEREAS,the subdivider in case SD -97-03 proposes to subdivide 45 acres in the Southwest quarter area of Section 31,Township 1 North,Range Eight East of the Gila and Salt River Base and Meridian,Pinal County,Arizona,into +210 residential lots pursuant to Article 6.2 of Chapter 4 of Title 9, Arizona Revised Statutes,and pursuant to the Apache Junction Subdivision Regulations;and WHEREAS,the Apache Junction Planning and Zoning Commission held a public hearing regarding SD -97-03 on September 23,1997,and recommended approval of SD- 97 -03 by a vote of 6 to 0;and WHEREAS,this Council finds this proposed subdivision to not be in conflict with the Medium Density,Open Space and Industrial designations of the Apache Junction General Plan;and WHEREAS,this Council finds this proposed subdivision to be in compliance with the Apache Junction Zoning Ordinance and the Apache Junction Subdivision Regulations;and WHEREAS,this Council finds that the stipulations required for this subdivision are necessary for sound and orderly community development,for preservation of community values and for the promotion of the general health, safety,convenience and welfare of the citizens of Apache Junction. NOW,THEREFORE,BE IT RESOLVED by the Mayor and City Council of the City of Apache Junction,Arizona,that: Said preliminary subdivision plat,SD -97-03,Ironwood Estates,be conditionally approved subject to the following stipulations and conditions: 1)An extension of the water distribution system from 36th Avenue will be required to serve this project.Additional right-of-way or public utility easements may be required (to be shown on the final plat). 2)An additional sewer line shall be stubbed out to the east subdivision boundary along the 36th Avenue alignment for possible future connection of property to the northeast. 3)No sewer manholes shall be constructed within the channel or basin at Tract B to prevent infiltration around the lid. 4)Access to the present sewage lift station must remain. RESOLUTION NO.97-26 PAGE 1 OF 2 5)Appropriate box culverts for drainage and all-weather access purposes shall be constructed at the 36th Avenue entrance. 6)The developer shall coordinate and construct all on -site and off- site improvements (roads,curbing,sidewalks, gutters, streetlights, retention basins,drainage easements,etc.)to the City Engineer's standards. 7)Internal and external development of street lighting on 36th Avenue out to Ironwood Drive,must be initiated by the property owner to create an improvement district. 8)All open space tracts/parkway areas are to be maintained by the subdivision's homeowners association.All open space tracts/parkway areas are to comply with the "Homeowners'Association Maintained Open Space Standards",as required by the City's Parks and Recreation Department,including but not limited to insuring that the design of all retention basins incorporate a curvilinear layout avoiding straight side slopes with only rounded corners.
