A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,
ARIZONA,DECLARING THAT A PORTION OF A DRAINAGE EASEMENT DESCRIBED IN
INSTRUMENT NO.1996-025249,PINAL COUNTY RECORDERS,IS NO LONGER NECESSARY
FOR USE AS A DRAINAGE EASEMENT AND IS HEREBY ABANDONED AND EXTINGUISHED
AS A PRESENT OR FUTURE EASEMENT.
WHEREAS,the requested abandonment is for an easement granted to Pinal
County Flood District for drainage purposes.The area to be abandoned is
described as a portion of the Northeast quarter of Section 33, Township 1 North,
Range 8 East of the Gila and Salt River Base and Meridian,Pinal County, Arizona,
and more particularly as follows:
Commencing at the North 1/4 corner of said Section 33,said point marked
by a Pinal County Highway Department brass cap in a hand hole:
Thence,North 89°53'26"East along the North line of the Northeast quarter
of said Section 33,a distance of 1282.37 feet to the Point of Beginning;
Thence,continuing North 89°5326"East,along the North line of the
Northeast quarter i f said Section 33,a distance of 40.00 feet to the
North 1/16 corner of said Section 33;
Thence,South 00°06 00"East a distance of 105.03 feet:
Thence.South 14°55'11"West a distance of 549.36 feet:
Thence.South 09°02'56"West a distance of 48.01 feet;
Thence,North 00 006 00"West a distance of 41.62 feet;
Thence.North 89°55 27"East a distance of 6.08 feet:
Thence.North 14°55'27"East a distance of 5.99 feet;
Thence,North 09°02'56"East a distance of 643.81 feet to the Point of
Beginning.
Said Parcel contains 0.466 acres,more or less.
WHEREAS,the City Council of The City of Apache Junction,Arizona,finds
that said Drainage Easement is not necessary for drainage purposes as described
in Instrument No.1996-025249.
NOW,THEREFORE,BE IT RESOLVED by the Mayor and City Council of the City
of Apache Junction, Arizona.that the above -described Drainage Easement is hereby
extinguished and abandoned as present or future drainage easement.
