HomeMy WebLinkAboutRES 98-24RESOLUTION NO.98-24 A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,APPROVING PRELIMINARY SUBDIVISION REPLAT,CASE NO.SD -98-02,SUNRISE RV RESORT,TRACT C:WHICH IS ALSO A REPLAT AND REDESIGNATION OF USE FOR TRACT C AS APPROVED BY CASE NO.SD -83-01,SUNRISE RV RESORT. WHEREAS,the subdivider in case SD -98-02 proposes to replat, redesignate,and subdivide 1.5 -net acres in the Northeast Quarter of Section 29,T.1 N.,R7 8 E.,Gila and Salt River Base and Meridian,Pinal County, Arizona,into 17 residential lots pursuant to Arizona Revised Statutes Annotated ("A.R.S.")§9-463 et seq.,and pursuant to the Apache Junction Subdivision Regulations set forth in the Apache Junction City Code ("A.J.C.C."),Volume II,Land Development Code,Chapter 2:and WHEREAS,the Apache Junction Planning and Zoning Commission held a public hearing regarding SD -98-02 on July 28,1998 and recommended approval of the subdivision replat and redesignation of use for Tract C by a vote of 7 to 0:and WHEREAS,this Council finds this proposed subdivision replat and redesignation of use for Tract C to be in compliance with the Apache Junction Zoning Ordinance pursuant to Ordinance Number 1008 (companion case PZ-97-15) granting a major planned development amendment to the final planned development plan pursuant to Ordinance Number 190 (companion case PZ-83-17) changing the use of Tract C to allow additional recreational vehicle lots and with the Apache Junction Subdivision Regulations as referenced above:and WHEREAS,this Council finds this proposed subdivision replat and redesignation of use for Tract C to not be in conflict with the Recreational Vehicle Park (RVP)designation of the Apache Junction General Plan:and WHEREAS,this Council finds this proposed subdivision replat and redesignation of use for Tract C to be in compliance with the Apache Junction Zoning Ordinance:and RESOLUTION NO.98-24 PAGE 1 OF 2 WHEREAS,this Council finds that the stipulations required for this subdivision are necessary for sound and orderly community development,for preservation of community values and for the promotion of the general health, safety,convenience,and welfare of the citizens of Apache Junction. NOW,THEREFORE,BE IT RESOLVED by the Mayor and City Council of the City of Apache Junction,Arizona,that: Said preliminary subdivision replat and redesignation of use for Tract C,SD -98-02,Sunrise RV Resort,be conditionally approved subject to the following stipulations and conditions: 1)All outstanding conditions of Ordinance No.1008,the planned development amendment approving additional recreational vehicle lots in Tract C of Sunrise RV Resort,that are still in effect shall apply. PASSED AND ADOPTED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,ARIZONA,THIS 1ST DAY OF SEPTEMBER .1998. SIGNED AND ATTESTED TO THIS 1ST DAY OF SEPTEMBER 1998.
