A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE
JUNCTION,ARIZONA,APPROVING PRELIMINARY SUBDIVISION PLAT,CASE NO.
SD -97-10,SUNRISE SHADOWS,BY CHPV DEVELOPMENT,SCOTTSDALE,ARIZONA.
WHEREAS,the subdivider in case SD -97-10 proposes to subdivide 15 acres at
the northwest corner of San Marcos Drive and 12°Avenue,into 48 single family
residential lots pursuant to Arizona Revised Statutes Annotated §9.463 et seq.,
and pursuant to the Apache Junction City Code (hereinafter "A.J.C.C.),Vol.II,
Land Development Code (hereinafter "L.D.C."),Chapter 2,Subdivision Regulations;
and
WHEREAS,the Apache Junction Planning and Zoning Commission held a public
hearing regarding SD -97-10 on July 25,1998 and recommended approval of SD -97-10
by a vote of 5 to 2;and
WHEREAS,this Council finds this proposed subdivision to be consistent with
the Medium Density designation of the Apache Junction General Plan;and
WHEREAS,this Council finds this proposed subdivision to be in compliance
with the A.J.C.C.,Vol.II,L.D.C.,Chapter 2,Subdivision Regulations;and
WHEREAS,this Council finds that the stipulations required for this
subdivision are necessary for sound and orderly community development,for
preservations of community values and for the promotion of the general health,
safety,convenience,and welfare of the citizens of Apache Junction.
NOW,THEREFORE,BE IT RESOLVED by the Mayor and City Council of the City
of Apache Junction,Arizona,that:
Said preliminary subdivision plat,SD -97-10,for Sunrise Shadows
Subdivision be conditionally approved subject to the following stipulations and
conditions:
1.The Final Plat is to be in substantial conformance with the approved
preliminary plat.

2.All requirements of the City of Apache Junction,with special
attention to the engineering requirements,shall be completely
satisfied.The following half -street widths will be required to be
dedicated to the City,40'along San Marcos and 30'along 12°
Avenue.
3.Lots 1 thru 4,and 36 thru 48 shall be restricted to single story
homes only.The homes on the remainder of the lots within the
subdivision may be either one or two stories.The maximum height
allowance of the CR-3 zone is 25'.Deed Restrictions,running with
the land,shall be created and shall apply to all successors in
interest of each lot as to the limitations set forth above.
4.All construction associated with this proposal shall comply with the
Uniform Building Code,and all other applicable codes and standards
as adopted by the City of Apache Junction.
5.All HVAC or air conditioning units are to be ground -set,no roof-
mounted units.

ARIZONA,THIS 3RD DAY OF NOVEMBER ,199 .
