A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY
OF APACHE JUNCTION,ARIZONA,APPROVING A MAJOR
AMENDMENT TO CONDITIONAL USE PERMIT RESOLUTION NO.
CUP -94-01,CONDITION NUMBER 3,ALLOWING TREND HOMES OF
ARIZONA,INCORPORATED,TO PLACE ONE OFF -SITE SIGN ON
THE ARIZONA STATE TRUST LAND/APACHE CREEK GOLF CLUB
PROPERTY,WHICH ADVERTISES TREND HOMES'RESIDENCES IN
THE IRONWOOD ESTATES SUBDIVISION.
WHEREAS,the subject property of this present Conditional Use Permit
("CUP")major amendment application,Case No.CUP -98-04,is Arizona State
Trust Land property,under the trust of the Arizona State Land Department and
leased by the Apache Creek Golf Club ("Applicant");and
WHEREAS,on or about June 24,1998,a CUP major amendment application
was filed by Applicant,requesting that Trend Homes of Arizona,Incorporated,
be permitted to place on Applicant's leased property,three off -site signs
advertising Trend Homes'single family residential development commonly known
as "Ironwood Estates Subdivision",located approximately li mile due west of
Applicant's leased property ("property")at the southwest corner area of the
superstition Freeway/US60 and the South Delaware Drive alignment;and
WHEREAS,in their CUP major amendment application,Applicant requested
Trend Homes'placement of three directional signs to be located along
Applicant's west property frontage between US60 and the West 36" Avenue
alignment,along South Ironwood Drive,directing interested purchasers of
Trend Homes residences to Ironwood Estates,which is accessed via West 36"
Avenue;and
WHEREAS,on September 8,1998,the Apache Junction Planning and Zoning
Commission held a public hearing (Case No.CUP -98-04)to consider Applicant's
request;and
WHEREAS,the Apache Junction Planning and Zoning Commission voted three
in favor of granting the request and three opposed,thereby causing a
procedural denial of such request;and
WHEREAS,on or about September 11,1998,pursuant to Apache Junction
City Code,Vol.II,Land Development Code,Chapter 1,Zoning Ordinance Sign
Code §21.46(b),Trend Homes,with consent of Applicant,submitted an appeal of

the Planning and Zoning Commission decision,and further requested a
modification of the original request from three signs to one double -sided
eight -foot by ten -foot pole -mounted sign to be located near the intersection
of South Ironwood Drive and West 36°Avenue,and whose westernmost edge will
be approximately five feet east of the west net property boundary of the
property legally described as follows:
That portion of the Southwest quarter of Section 32,
Township 1 North,Range 8 East of the Gila and Salt
River Base and Meridian,Apache Junction,Pinal
County,Arizona,lying South of the South right-of-way
line of the Superstition Freeway/US60.
NOW,THEREFORE,BE IT RESOLVED,pursuant to Apache Junction City Code,
Vol.II,Land Development Code,Chapter 1,Zoning Ordinance Sign Code §21.43,
after consideration of all of the factors relating to the proposed sign
discussed and presented at the November 3,1998,public hearing on the appeal
of Case No.CUP -98-04,the Mayor and City Council of the City of Apache
Junction,Arizona,find that placement of such sign does not adversely affect
the public health,safety and welfare;and that Applicant's modified request
for a CUP major amendment be approved,thus necessarily and desirably
rewriting and amending Condition Number 3 of Conditional Use Permit Resolution
No.CUP -94-01,allowing Trend Homes of Arizona,Incorporated,to erect and
place one sign,five feet from the west net property boundary of the Apache
Creek Golf Club property as more fully described above,directing interested
persons to the Ironwood Estates Subdivision,as follows and to further the
goals of the above -referenced Sign Code:
3)The golf course shall be allowed on -site signage as permitted for uses
in commercial districts,including the use of banners,but shall not be
allowed to erect off -site signs anywhere in the City.Trend Homes of
Arizona,Incorporated,however,may erect one sign on the golf course
property subject to the following additional conditions:
a)Said sign is approved specifically for Trend Homes of Arizona,
Incorporated,and shall only advertise the single family homes in
the Ironwood Estates Subdivision,located at the southwest corner
area of the Superstition Freeway/US60 and the South Delaware Drive
alignment,approximately ½ mile due west of the golf course.
b)The sign shall be a detached,pole -mounted sign,with a maximum
height of twelve feet measured from the ground to the top of the
sign,and such advertising area shall be no larger than eight feet
by ten feet.

c)Before erecting such sign,Applicant must first deliver to the
Planning and Building Divisions of the Development Services
Department of the City of Apache Junction a certified approval by
the Arizona State Land Department allowing such sign to be placed
on the subject property.
d)The sign,once erected,shall only be maintained at such location
for two years,calculated from the effective date of the Arizona
State Land Department approval,after which time it shall be
removed by Applicant.
e)Before erecting the sign,Applicant shall obtain all necessary
sign permits and inspections,as required by the Apache Junction
City Code,Vol.II,Land Development Code,Chapter 1,Zoning
Ordinance Sign Code,§21.00,et seq.
f)Applicant shall maintain the sign in a safe,presentable and good
condition,and shall replace all defective parts,and shall
repaint and clean as needed and directed by the Apache Junction
Building Official.
g)Should any of the above -referenced conditions be violated,the
Apache Junction Zoning Administrator may schedule the CUP for a
revocation hearing before the Apache Junction City Council.
