A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,
ARIZONA,AUTHORIZING AND DIRECTING THE CITY MANAGER TO ORDER THE
INSTALLATION OF STREET LIGHTS WITHIN AN AREA DESCRIBED AS IRONWOOD COVE
II,A SUBDIVISION RECORDED IN CABINET C,SLIDE 033,PINAL COUNTY RECORDER,
PINAL COUNTY,ARIZONA.
WHEREAS,the Mayor and City Council on March 2,1999,did pass Resolution
of Intention No.98-34,declaring the intention of the City of Apache Junction
to purchase electricity including a charge for the use of lighting facilities,
for lighting an area described as Ironwood Cove II,a Subdivision recorded in
Cabinet C.Slide 033,Pinal County Recorder,Pinal County,Arizona:and
WHEREAS,the cost of the lighting is to be assessed on a certain district,
known as the Apache Junction Street Light Improvement District No.SLID 9801-1:
and
WHEREAS,the petition was signed by all of the real property owners in the
proposed district,exclusive of mortgagees and other lienholders,and was filed
with the Apache Junction City Clerk:and
WHEREAS,the governing body shall have immediate jurisdiction to adopt the
resolution ordering the improvement pursuant to provisions of Arizona Revised
Statutes Annotated ("A.R.S.")§48-581,without the necessity of the publication
and posting of the Resolution of Intention provided for in A.R.S.§48-578,
pursuant to the provisions of A.R.S.§48-575(C).
NOW,THEREFORE,BE IT RESOLVED,by the Council of the City of Apache
Junction,Arizona,that the City Engineer be empowered and directed to proceed
with the improvements.
PASSED AND ADOPTED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,
ARIZONA,THIS 2ND DAY OF MARCH .1999.
